Advance Contract Award Notice (ACAN) An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 2. Definition of the requirement The Department of Fisheries and Oceans, Canadian Coast Guard (CCG) has a requirement for 72 Capacitors 5MPF-21393K that are Original Equipment Manufacturer (OEM) certified Spare Parts for the RC filters of the Ingeteam LV4717-A frequency converters fitted in the propulsion system of the OFSV Vessels. 3. Criteria for assessment of the Statement of Capabilities Any interested supplier must demonstrate by way of a statement of capabilities that its parts and service meets the following requirements: The Canadian Coast Guard requires 72 Capacitors 5MPF-21393K that is Original Equipment Manufacturer (OEM) certified Spare Parts for the Ingeteam LV4717-A frequency converters fitted to the OFSV Vessels. To be considered, Offerors must meet all of the following capabilities: a. The Offeror must be able to provide Ingeteam OEM Capacitors 5MPF-21393K Spare Parts; b. The Offeror must have access to Ingeteam technical bulletins and intellectual property of Ingeteam equipment fitted to CCG OFSV vessels; c. The Offeror must have direct access to Ingeteam warranty procedures: and, d The Capacitors must have been manufactured within the past 2 years. 4. Applicability of the trade agreement(s) to the procurement This procurement is subject to the following trade agreement: Canadian Free Trade Agreement (CFTA). This procurement is not subject to international trade agreements. 5. Set-aside under the Procurement Strategy for Indigenous Business (PSIB). Not applicable. 6. Comprehensive Land Claims Agreement(s) Not applicable. 7. Justification for the Pre-Identified Supplier Ingeteam S.A. is the only entity that is capable of meeting the Statement of Capabilities for the Contract Spare Capacitors Order for OFSV Propulsion Variable Frequency Drive (VFD). Ingeteam S.A. is the OEM provider of parts and service for the Ingeteam LV4717-A frequency converters and has licence IP rights. 8. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work: 9. Exclusions and/or Limited Tendering Reasons: Canadian Free Trade Agreement (CFTA) - Article 513, Limited Tendering sections (b)(iii) and (v). - (iii) due to an absence of competition for technical reasons; and - (v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative. The procurement under the Federal Supply Classification (FSC) 20, Ship and Marine Equipment by the Canadian Coast Guard is not subject to international trade agreements as per the following: a. World Trade Organization - Agreement on Government Procurement (WTO-AGP) Canada Goods Annex 4, 2nd paragraph "with respect to procurement by Canadian Coast Guard, ... this Agreement covers only the goods described in the Federal Supply Classifications (FSC) listed below". b. Canada-European Union Comprehensive Economic and Trade Agreement (CETA) Canada Annex 19-4 - Goods, 2nd paragraph. c. Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) Annex 15-A, Schedule of Canada, Section D, Goods, 2nd paragraph. d.
