Jamstvo za ozbiljnost ponude dostavlja se u obliku bezuvjetne i neopozive bankarske garancije, naplative od banke na prvi poziv, bez prava protesta i treba imati rok valjanosti najmanje jednak roku valjanosti ponude. Dostavljeno jamstvo mora biti naplativo i sukladno uvjetima iz ove dokumentacije o nabavi. U slučaju zajednice gospodarskih subjekata jamstvo za ozbiljnost ponude dostavlja bilo koji član iz zajednice ponuditelja, u cijelosti ili parcijalno s članom/vima, pod uvjetom da jamstvo za ozbiljnost ponude, u bilo kojem slučaju treba biti u obliku i iznosu kako je traženo ovom točkom. Javni naručitelj će jamstvo za ozbiljnost ponude zadržati i naplatiti u slučaju: - odustajanja ponuditelja od svoje ponude u roku njezine valjanosti, - nedostavljanja ažuriranih popratnih dokumenata sukladno članku 263. ZJN 2016, - neprihvaćanja ispravka računske greške, - odbijanja potpisivanja ugovora o javnoj nabavi ili okvirnog sporazuma - nedostavljanja jamstva za uredno ispunjenje ugovora o javnoj nabavi ili okvirnog sporazuma ako okvirni sporazum obvezuje na sklapanje i izvršenje. Rok valjanosti bankarske garancije mora biti najmanje do isteka roka valjanosti ponude. Jamstvo za ozbiljnost ponude dostavlja se u izvorniku, odvojeno od elektroničke ponude, u papirnatom obliku. Ako tijekom postupka javne nabave istekne rok valjanosti ponude i jamstva za ozbiljnost ponude, Naručitelj je obvezan prije odabira zatražiti produženje roka valjanosti ponude i jamstva od Ponuditelja koji je podnio ekonomski najpovoljniju ponudu u primjernom roku ne kraćem od 5 dana. Umjesto traženog jamstva ponuditelj može uplatiti novčani polog u traženom iznosu na račun javnog naručitelja. U tom slučaju ponuditelj dokaz o uplati novčanog pologa prilaže u svojoj ponudi. Dokazom o plaćanju novčanog pologa na temelju kojeg se može utvrditi da je transakcija izvršena smatraju se i neovjerene preslike ili ispisi provedenih naloga za plaćanje, uključujući i onih izdanih u elektroničkom obliku. Novčani polog koji se daje u svrhu jamstva za ozbiljnost ponude, mora biti vidljiv na računu Naručitelja u roku za dostavu ponuda. Povrat novčanog pologa izvršit će se posredovanjem banke, bez kamata, uplatom naznačenog pologa na račun ponuditelja u skladu s odredbama članka 177. Zakona o obveznim odnosima (NN 35/05, 41/08, 125/11, 78/15, 29/18, 126/21, 114/22, 156/22).
