If a deadline for the submission of bids is set in the procurement procedure, objections to the procurement conditions must be delivered to the Employer by the end of this deadline at the latest. Objections to the content of the call for tenders in the dynamic purchasing system or when awarding a public contract based on a framework agreement must be delivered to the contracting authority no later than the end of the period for submitting tenders.In a competition for a proposal, objections to the competition conditions must be delivered no later than the end of the deadline for submitting proposals. The contracting authority may stipulate in the procurement documentation or competition conditions that objections pursuant to § 242, paragraph 3 or 4 of the Act can be submitted no later than 72 hours before the end of the deadlines pursuant to § 242, paragraph 3 or 4 of the Act. Objections to the voluntary notification of the intention to enter into a contract pursuant to § 212 paragraph 2 of the Act must be delivered to the Employer within 30 days of the publication of this notification. The contracting authority is obliged to resolve objections within 15 days. The proposal must be delivered to the ÚOHS and to the Contracting Authority within 10 days from the day on which the complainant received the decision by which the Contracting Authority rejected the objections or within 25 days from sending the objections, if the Contracting Authority has not decided on the objections. After the conclusion of a contract for a public order or a framework agreement, only a proposal to impose a ban on the performance of the contract can be submitted, even without prior submission of objections. The proposal to impose a ban on performance of the contract shall be delivered by the proposer to the ÚOHS and, in a copy, to the Contracting Authority within 30 days from the date on which the Contracting Authority published a notice of the conclusion of the contract in accordance with § 212, paragraph 2 of the Act, stating the reason for awarding the public contract without publishing a notice of the initiation of the procurement procedure, preliminary announcements or invitations to submit offers in the simplified sub-limit procedure, but no later than 6 months after the conclusion of this contract. Proposal to impose a ban on performance of the contract pursuant to § 254 paragraph 1 letter d) of the Act shall be delivered by the proposer to the ÚOHS and in a copy to the Contracting Authority within 30 days from the date on which the Contracting Authority published a notice of conclusion of a contract based on a framework agreement pursuant to Section 137 of the Act or a notice of the conclusion of a contract in a dynamic purchasing system pursuant to Section 142 of the Act, but no later than 6 months from the conclusion of this contract. Within the deadline for delivery of the proposal, the proposer is obliged to deposit a deposit in the account of the ÚOHS in the amount of 1% of the offer price of the proposer for the entire period of performance of the public contract or for the period of the first four years of performance in the case of contracts for an indefinite period, but at least in the amount of CZK 50,000, at most in the amount of CZK 10,000,000. In the event that the proposer cannot determine the total tender price, he is obliged to post a deposit of CZK 100,000. In the case of a proposal to impose a ban on performance of the contract, the proposer is obliged to post a bond in the amount of CZK 200,000. If it is a procedure for reviewing the procedure for awarding concessions, the proposer is obliged, within the deadline for delivery of the proposal, to deposit a deposit in the account of the ÚOHS in the amount of 1% of the estimated value of the concession published in the Journal of Public Procurement or on the profile of the Contracting Authority, but at least in the amount of CZK 50,000 , no more than CZK 10,000,000. In the event that the Contracting Authority does not publish the expected value of the concession in the Public Procurement Gazette or on the Contracting Authority's profile, the proposer is obliged to post a deposit in the amount of CZK 100,000. In the case of a proposal to impose a ban on the performance of the concession contract, the proposer is obliged to post a bond in the amount of CZK 200,000. 5.1.15.
