Minimální úroveň pro naplnění tohoto kritéria splní dodavatel, který doloží seznam služeb s uvedením alespoň a) 1 služby poskytnuté v období pěti let před dnem podání nabídky, jejímž předmětem (nebo součástí) bylo provozování čistírny odpadních vod pro veřejnou potřebu ve smyslu § 8 odst. 2 ZVK, a to v min. objemu 5 000 ekvivalentních obyvatel a v minimální délce nepřetržitého provozu ČOV 36 měsíců a zároveň b) 1 služby poskytnuté v období pěti let před dnem podání nabídky, jejímž předmětem (nebo součástí) bylo provozování kanalizace pro veřejnou potřebu, a to v min. objemu 62 odběratelů a v minimální délce nepřetržitého provozu kanalizace 36 měsíců. Dodavatel prokáže kvalifikaci, pokud předloží seznam významných služeb, ze kterého bude naplnění minimální úrovně dle předchozího odstavce prokazatelně a jednoznačně vyplývat. Zadavatel může ve smyslu § 79 odst. 1 ZZVZ považovat technickou kvalifikaci za neprokázanou, pokud prokáže, že dodavatel má protichůdné zájmy, které by mohly negativně ovlivnit plnění veřejné zakázky. Osvědčení o vzdělání a odborné kvalifikaci Dodavatel předloží dále ve smyslu § 79 odst. 2 písm. d) ZZVZ osvědčení o vzdělání a odborné kvalifikaci vztahující se k provozu čistírny odpadních vod pro veřejnou potřebu, a to doložením následujících dokumentů ve vztahu k osobám, které budou mít odpovědnost za realizaci předmětu pachtovní smlouvy (provoz VHI Semily): - profesní životopis, - osvědčení o dosaženém vzdělání, - čestné prohlášení dané osoby o pravdivosti údajů uvedených v profesním životopise, a - čestné prohlášení dodavatele o pracovněprávním vztahu dané osoby (osob) a dodavatele a odpovědnosti této osoby (osob) za realizaci předmětu pachtovní smlouvy. Minimální úroveň pro naplnění tohoto kritéria splní dodavatel, pokud za realizaci předmětu pachtovní smlouvy bude mít odpovědnost: o alespoň jedna osoba s vysokoškolským vzděláním v akreditovaném studijním programu v oblasti vodovody a kanalizace naplňujícího ustanovení § 12a odst. 1 vyhlášky č. 428/2001 Sb. a minimálně pěti roky pracovní praxe v oboru vodovody a kanalizace. Nabídky budou hodnoceny podle jediného kritéria, kterým je ekonomická výhodnost nabídky spočívající ve výši celkových provozních nákladů na provozování VHI Semily uvedeného dodavateli v nabídce. Hodnocení provede zadavatel sestavením pořadí nabídek od nabídky s nejnižšími nabízenými provozními náklady po nabídku s nejvyššími nabízenými provozními náklady. Jako ekonomicky nejvýhodnější bude vyhodnocena nabídka s nejnižšími nabízenými provozními náklady. Zadavatel posoudí kvalifikaci u dodavatele, jehož nabídka byla vyhodnocena jako ekonomicky nejvýhodnější. V případě, že tento dodavatel neprokázal splnění kvalifikačních kritérií podle této zadávací dokumentace, zadavatel jej vyloučí. V takovém případě provede zadavatel obdobným způsobem posouzení kvalifikace u dodavatele, jehož nabídka byla vyhodnocena jako druhá ekonomicky nejvýhodnější, a v případě potřeby tento postup dále opakuje. Námitky proti úkonům oznamovaným v dokumentech, které je Zadavatel povinen podle zákona uveřejnit či odeslat stěžovateli, musí být doručeny Zadavateli do 15 dnů od jejich uveřejnění či doručení stěžovateli. Pokud je v zadávacím řízení stanovena lhůta pro podání žádostí o účast, musí být námitky proti podmínkám vztahujícím se ke kvalifikaci dodavatele doručeny Zadavateli nejpozději do skončení této lhůty. V soutěži o návrh musí být námitky proti soutěžním podmínkám doručeny nejpozději do konce lhůty pro podání návrhů. Zadavatel může v zadávací dokumentaci nebo soutěžních podmínkách stanovit, že námitky podle § 242 odst. 3 nebo 4 zákona lze podat nejpozději 72 hodin před skončením lhůt podle § 242 odst. 3 nebo 4 zákona. Námitky proti dobrovolnému oznámení o záměru uzavřít smlouvu podle § 212 odst. 2 zákona musí být doručeny Zadavateli do 30 dnů od uveřejnění tohoto oznámení. Zadavatel je povinen námitky vyřídit do 15 dnů. Návrh je nutné doručit ÚOHS i Zadavateli do 10 dnů ode dne, v němž stěžovatel obdržel rozhodnutí, kterým Zadavatel námitky odmítnul nebo do 25 dnů od odeslání námitek, pokud Zadavatel o námitkách nerozhodl. Po uzavření smlouvy na veřejnou zakázku či rámcové dohody lze podat pouze návrh na uložení zákazu plnění smlouvy, a to i bez předchozího podání námitek. Návrh na uložení zákazu plnění smlouvy doručí navrhovatel ÚOHS a ve stejnopisu Zadavateli do 30 dnů ode dne, kdy Zadavatel uveřejnil oznámení o uzavření smlouvy způsobem podle § 212 odst. 2 zákona s uvedením důvodu pro zadání veřejné zakázky bez uveřejnění oznámení o zahájení zadávacího řízení, předběžného oznámení nebo výzvy k podání nabídek ve zjednodušeném podlimitním řízení, nejpozději však do 6 měsíců od uzavření této smlouvy. Návrh na uložení zákazu plnění smlouvy podle § 254 odstavce 1 písm. d) zákona doručí navrhovatel ÚOHS a ve stejnopisu Zadavateli do 30 dnů ode dne, kdy Zadavatel uveřejnil oznámení o uzavření smlouvy na základě rámcové dohody podle § 137 zákona nebo oznámení o uzavření smlouvy v dynamickém nákupním systému podle § 142 zákona, nejpozději však do 6 měsíců od uzavření této smlouvy. Ve lhůtě pro doručení návrhu je navrhovatel povinen složit na účet ÚOHS kauci ve výši 1 % z nabídkové ceny navrhovatele za celou dobu plnění veřejné zakázky nebo za dobu prvních čtyř let plnění v případě smluv na dobu neurčitou, nejméně však ve výši 50 000 Kč, nejvýše ve výši 10 000 000 Kč. V případě, že navrhovatel nemůže stanovit celkovou nabídkovou cenu, je povinen složit kauci ve výši 100 000 Kč. V případě návrhu na uložení zákazu plnění smlouvy je navrhovatel povinen složit kauci ve výši 200 000 Kč. The minimum level for fulfilling this criterion will be met by a supplier who documents a list of services indicating at least a) 1 service provided in the period of five years before the date of submission of the offer, the subject (or part) of which was the operation of a wastewater treatment plant for public use in the sense of § 8 par. 2 ZVK, in min.with a volume of 5,000 equivalent inhabitants and a minimum duration of continuous operation of the WWTP of 36 months and at the same time b) 1 service provided in the period of five years prior to the date of submission of the offer, the subject (or part) of which was the operation of sewage for public use, in min. volume of 62 customers and a minimum duration of continuous operation of the sewage system of 36 months. The supplier proves his qualification if he submits a list of important services, from which the fulfillment of the minimum level according to the previous paragraph will demonstrably and unambiguously result. Pursuant to Section 79, paragraph 1 of the ZZVZ, the contracting authority may consider the technical qualification to be unproven if it proves that the contractor has conflicting interests that could negatively affect the performance of the public contract. The Supplier shall also submit a certificate of education and professional qualification in accordance with § 79 paragraph 2 letter d) ZZVZ certificate of education and professional qualification related to the operation of a wastewater treatment plant for public use, by submitting the following documents in relation to the persons who will be responsible for the implementation of the subject of the lease agreement (operation of VHI Semily): - professional resume, - certificate of educational attainment, - affidavit of the given person on the truthfulness of the information given in the professional resume, and - a sworn statement of the supplier on the employment relationship between the given person(s) and the supplier and the responsibility of this person(s) for the implementation of the subject of the tenancy agreement.
