Open House Contract for the Supply of Prescribeable Medical Devices Within the Meaning of Section 31 Sgb V - Bandages and other Wound Treatment Products Prescribed for Individual Patients I. General This is not an open procedure, but rather a so-called open-house model! The form for the open procedure is only used because there is no form for the open house model. Contracts concluded in the open-house model are subject to mangels selection decision not based on procurement law. The use of this form does not involve subjection to procurement regulations. The content of the open house procedure is the conclusion of a non-exclusive contract for the supply of prescription medical deviceswithin the meaning of Section 31 SGB V, if not subject to pharmacy, here: patient-specifically prescribed dressings and other products for wound care within the meaning of Annex Va of the Medicines Directive The contracting parties conclude this contract in accordance with Section 31 Paragraph 1 Sentence 2 SGB V i. V. m. §§ 126, 127a. F. SGB V on the supply of AOK insured persons with bandages and other wound treatment products prescribed for each patient, provided that the products in question are not subject to pharmacy requirements. The contract serves to fulfill the claim of the insured person according to Section 31 paragraphsee 1 sentences 1 and 2 SGB V i. V. m. the guidelines according to Section 92 Paragraph 1 Sentence 2 No. 6 SGB V. The aim of the contracting parties is to ensure the high-quality and economical supply of the insured persons with the products covered by the contract and to provide clear, uniform information for everyone involved...
