Die GWQ geht davon aus, dass dieses Verfahren aufgrund einer fehlenden Auswahlentscheidung und mithin der diskriminierungsfreien Zugangsmöglichkeit aller pharmazeutischen Unternehmen nicht in den Anwendungsbereich des Kartellvergaberechts fällt.
