General information Additional information: 1. Ajánlatkérő a Kbt. 71. § (6) bekezdés második mondatára figyelemmel előírja, hogyha a hiánypótlással az ajánlattevő az ajánlatban korábban nem szereplő gazdasági szereplőt von be az eljárásba, és e gazdasági szereplőre tekintettel lenne szükséges az újabb hiánypótlás, akkor az ajánlatkérő kizárólag egy alkalommal fog újabb hiánypótlást elrendelni. 2. Ajánlatkérő előírja, hogy az ajánlatban meg kell jelölni a közbeszerzésnek azt (azokat) a részét (részeit), amelynek teljesítéséhez az ajánlattevő alvállalkozót kíván igénybe venni, az ezen részek tekintetében igénybe venni kívánt és az ajánlat benyújtásakor már ismert alvállalkozókat, valamint az ajánlattevői teljesítésen belül az alvállalkozói teljesítés tervezett százalékos arányát. 3. Ajánlatkérő jelen eljárásban alkalmazza a Kbt. 75. § (2) bekezdés e) pontját. 4. Kérjük az ajánlati ár ellenőrzéséhez az árazott költségvetés(eke)t excel formátumban is feltölteni az EKR-be. Az ajánlat részeként csatolni kell az ajánlattevő és az alkalmasság igazolásában részt vevő szervezet nevében aláíró személy aláírási címpéldányát vagy aláírás-mintáját (a Kiegészítő dokumentumok III/12. pontjában részletezettek szerint). Természetes személy gazdasági szereplők vonatkozásában a személyazonosító okmány vagy egyéb, az aláírás hitelességének igazolására alkalmas dokumentum egyszerű másolati példányát fogadja el Ajánlatkérő aláírás-mintaként. Ha a kötelezettségvállaló (ajánlatot aláíró) személye nem azonos a cégjegyzésre jogosulttal, úgy a jogosultságot meghatalmazással kell igazolni. 7. A Kbt. 44. § (1) bekezdése alapján ajánlattevő az ajánlatában - kifejezetten és elkülönített módon, mellékletben - közölt üzleti titkot tartalmazó iratok nyilvánosságra hozatalát megtilthatja. 8. Ajánlatkérő a 322/2015. (X.30.) Korm. rendelet 26. §-a alapján előírja, hogy a nyertes ajánlattevőként szerződő fél legkésőbb a szerződés hatálybalépését követően köteles összkockázatú vagyon- és felelősségbiztosítást (C.A.R. rendszerű építés-szerelési biztosítás) kötni a szerződés tárgyára (építőipari kivitelezés), vagy a meglévő biztosítását kiterjeszteni a szerződés tárgyára (építőipari kivitelezés) is az előírt felelősségbiztosítási mértékre tekintettel. Ajánlatkérő a felelősségbiztosítás vonatkozásában az alábbi mértéket írja elő: kártérítési limit 80 millió forint/év, illetve káreseményenként 40 millió forint/kár. Nyertes ajánlattevő a biztosítások meglétét a munkaterület átadással egyidejűleg köteles igazolni. A biztosításnak a szerződés teljesítésének teljes időtartama alatt érvényben kell maradnia. 9. Ajánlatkérő tájékoztatja ajánlattevőket, hogy helyszíni bejárást nem tart. 10. Az ajánlatkérő jelen eljárásban alkalmazza a Kbt. 81. § (4)-(5) bekezdéseiben foglalt, a bírálat és értékelés speciális sorrendjét. 11. Ajánlatkérő felhívja Ajánlattevők figyelmét, hogy az árazott költségvetés szakmai ajánlatnak minősül, így annak teljes hiánya nem hiánypótolható hibának minősül, azaz az ajánlat érvénytelenségét eredményezi. 12. A részajánlattétel kizárásának indokai: Ajánlatkérő megvizsgálta a részajánlattétel lehetőségét és a gazdasági, műszaki és a szerződés teljesítésével kapcsolatos szempontokat figyelembe véve ésszerűtlen lenne annak biztosítása, mivel az építési beruházás minden eleme egy összefüggő, mindösszesen egy utcát érintő területre korlátozódik, ahogyan az a műszaki dokumentáció részét képező átnézeti helyszínrajzon látható. 13. Az ajánlat részeként csatolni kell az ajánlattevő az ukrajnai helyzetet destabilizáló orosz intézkedések miatt hozott korlátozó intézkedésekről szóló 833/2014/EU tanácsi rendelet 5k. cikk (1) bekezdése szerinti tilalomról szóló nyilatkozatát. 14. Ajánlatkérő tájékoztatja Ajánlattevőket, hogy jelen közbeszerzési eljárás a Kbt. 53. § (6) bekezdése szerint kerül megindításra, tekintettel arra, hogy Ajánlatkérő a szükséges pénzügyi fedezet biztosítására többlettámogatásra irányuló igényt fog benyújtani. Ajánlatkérő a többlettámogatásra irányuló igényének el nem fogadását, vagy az igényeltnél olyan mértékben kisebb összegben történő elfogadását, melyhez a további esetlegesen szükséges forrást nem tudja más módon bevonni, olyan körülménynek tekinti, mely alapján Ajánlatkérő a teljesítésre képtelenné válik és amely miatt az eljárást eredménytelenné nyilváníthatja. Ajánlatkérő a Kbt. 135. § (12) bekezdése alapján a többlettámogatási igény megítélését tartalmazó döntésről szóló értesítés Ajánlatkérő által történő átvételét a szerződés hatálybelépését felfüggesztő feltételként köti ki. Amennyiben a felfüggesztő feltétel nem következik be legkésőbb a vállalkozási szerződés mindkét fél általi aláírását követő 180. napig, a szerződés minden további jogcselekmény nélkül automatikusan megszűnik a mindkét fél általi aláírását követő 181. napon. 15. Jelen eljárásra az állami építési beruházások rendjéről szóló 2023. évi LXIX. törvényt nem kell alkalmazni, mert a törvény 61. § (3) bekezdése értelmében olyan építési beruházás az eljárás tárgya, amelyben az önkormányzat kedvezményezett részére a költségvetési vagy a nem közvetlen európai uniós forrás nyújtásáról szóló támogatási szerződés a törvény hatálybalépését megelőzően lépett hatályba. 16. A felhívásban nem szabályozott kérdések vonatkozásában a közbeszerzésekről szóló 2015. évi CXLIII. törvény, valamint a vonatkozó egyéb magyar jogszabályok előírásai szerint kell eljárni. 17. Korm. rendelet 2. § (5) bekezdése alapján előírja, hogy az EEKD IV. részének az α (alfa): „Az összes kiválasztási szempont általános jellemzése” pont kitöltésével kell előzetesen igazolni a felhívásban meghatározott alkalmassági minimumkövetelménynek való megfelelést. Az M.1. alkalmassági feltétel esetében rögzített igazolások benyújtása kizárólag ajánlatkérő Kbt. 69. § (4) bekezdése szerinti felkérése esetén szükséges. Kivételt képez ez alól az értékelési részszempontokra - a teljesítésbe bevonásra kerülő szakember szakmai tapasztalata - vonatkozóan bemutatott szakemberek szakmai önéletrajza, amelyeket teljes körűen (mind az alkalmasság szempontjából releváns tapasztalat, mind az értékelés szempontjából releváns többlettapasztalat bemutatásával) az ajánlathoz csatolni szükséges. Az előírt alkalmassági követelményeknek a közös ajánlattevők a Kbt. 65. § (6) és (7) bekezdése szerint felelhetnek meg. Ajánlattevő a Kbt. 65. § (7) bekezdése alapján más szervezet (vagy személy) kapacitására támaszkodva is megfelelhet, a közöttük fennálló kapcsolat jogi jellegétől függetlenül. Ebben az esetben meg kell jelölni az ajánlatban ezt a szervezetet és az ajánlati felhívás vonatkozó pontjának megjelölésével azon alkalmassági követelményt (követelményeket), melynek igazolása érdekében az ajánlattevő ezen szervezet erőforrására (is) támaszkodik. Kapacitást biztosító szervezet igénybevétele esetén az ajánlatban csatolni kell a kapacitásait rendelkezésre bocsátó szervezet olyan szerződésesben, előszerződésben vagy más formában vállalt kötelezettségvállalását tartalmazó okiratot, amely alátámasztja, hogy a szerződés teljesítéséhez szükséges erőforrások rendelkezésre állnak majd a szerződés teljesítésének időtartama alatt. Ehhez kapcsolódóan felhívjuk ajánlattevők figyelmét a Kbt. 65. § (9) és (12) bekezdésében foglaltakra. Ajánlatkérő felhívja a figyelmet a 321/2015. (X. 30.) Korm. rendelet 1. § (7) bekezdésére. Ajánlatkérő az alkalmassági feltételeket a minősített ajánlattevők jegyzékében szereplő előírásokhoz képest szigorúbban határozta meg az M.1. pont tekintetében. Korm. rendelet 1. melléklete VI./3. rész 17. pontja szerinti „MV-VI” kategóriájú felelős műszaki vezetői, vagy azzal egyenértékű jogosultsággal rendelkezik. Egy szakember több pozícióra is jelölhető. Az időben párhuzamos projektek esetében a szakmai tapasztalatot AK csak egyszer veszi figyelembe. A szakember tapasztalatát év, hónap pontossággal kérjük bemutatni. AK a jogosultság megszerzéséhez szükséges végzettséggel, illetve képzettséggel egyenértékű végzettséget, illetve képzettséget is elfogad valamennyi szakember esetében. Ajánlatkérő a bemutatott szakemberek tekintetében a 266/2013. (VII. 11.) Korm. rendelet 11. § (1) bekezdésében foglaltakkal összhangban szakmai gyakorlati időként az építési műszaki ellenőri és a felelős műszaki vezetői jogosultsághoz a szakirányú végzettség megszerzését követően a kérelmezett szakmagyakorlási tevékenységi szakterületnek megfelelő: a) építési műszaki ellenőri, b) felelős műszaki vezetői, c) építőipari kivitelezési, d) építésfelügyeleti, e) építésügyi hatósági, f) beruházói-műszaki, g) felsőoktatási intézményben építészeti-műszaki szaktárgy oktatói, h) építészeti-műszaki tervezési, i) építésügyi műszaki szakértői tevékenység folytatásának időtartamát veszi figyelembe. Ajánlatkérő a 321/2015. (X.30.) Korm. rendelet 21. § (2a) bekezdés a) pontja alapján a vizsgált 5 éves időszak alatt befejezett, de legfeljebb 8 éven belül megkezdett építési beruházásokat veszi figyelembe. Ajánlatkérő felhívja a figyelmet a Kbt. 67. § (1) és (2) bekezdésében foglaltakra. AK a 321/2015. (X. 30.) In the case of a joint offer, the Kbt. According to § 35, the lead company must be designated and the joint bidders must assume joint responsibility, as well as conclude a consortium agreement and attach it to the bid. In the case of a joint tender, the joint tenderer agreement signed by the joint tenderers must be attached, which meets all the following requirements: • contains the tenderers' details (name, registered office), • the name of the tenderer leading the joint tender, who is entitled to represent the joint tenderers (the joint tenderers all statements made on his behalf must clearly include the designation of the joint bidders), • a statement that the joint bidders assume joint responsibility for the performance of the contract, • the party/parties entitled to sign the contract in the event of a win, • the rules of cooperation between the bidders: the division of tasks, the percentage distribution of tasks, the method of mutual financial settlement, • authorization, which includes the fact that the economic operator entitled to represent the joint tenderers may act on behalf of the individual joint tenderers when making declarations to be made electronically in the EKR with regard to the given procedure, subject to the Code of Civil Procedure . to the provisions of paragraph (2a) of § 35. Guarantees of the contract: Rate of penalty for delay: 0.5% of the net compensation according to the contract/day after every calendar day started (affected by delay), but a maximum of 10% of the net compensation according to the contract. If the successful Bidder is in a delay of more than 20 calendar days, the Bidder is entitled to withdraw from the contract with a unilateral declaration or to terminate the contract with immediate effect, and to deduct the damages and additional costs due to the failure from the contractual consideration of the work performed up to the termination due to the successful Bidder. Failure penalty rate: 15% of the net compensation according to the contract. As a guarantee for claims related to the defective performance of the contract, the contracting authority shall provide a guarantee in the amount of 5% of the net consideration according to the contract in accordance with the Code of Civil Procedure. Financial arrangement: The winning tenderer may submit 4 partial invoices and 1 final invoice as follows, based on the technical inspector's proposal, after the actual performance certified by the contracting authority: 1st partial invoice: In the case of completed performance reaching 15% of completion - the total net 15% of contractor's fee, sub-account 2:In case of completed performance reaching 40% of readiness - 25% of the total net contractor's fee, sub-invoice 3: In case of realized performance reaching 60% of readiness - 20% of the total net contractor's fee, sub-invoice 4: In case of completed performance reaching 80% of readiness - 20% of the total net contractor's fee, Final invoice: in case of completed performance reaching 100% of readiness - 20% of the total net contractor's fee.
