100 分の 10 に相当する額を加算した金額(当該金額に１円未満の端数があるときは、その端数金額を切り捨てた金額)をもって落札価格とするので、入札者は、消費税及び地方消費税に係る課税事業者であるか免税事業者であるかを問わず、見積もった契約希望金額の 110分の100に相当する金額を入札書に記載すること。(３)個々の入札物件の第１回目の入札に際し、入札書とともに事業費内訳書を提出すること。事業費内訳書の様式は自由であるが、作業種別数量、単価、金額等が記載されたものとする。(４)入札参加者は、暴力団排除に関する誓約事項(別添１)について入札前に確認しなければならず、入札書の提出をもってこれに同意したものとする。(５)電子調達システムによる手続き開始後の紙入札方式への途中変更は、原則として行わないものとするが、入札参加者側にやむを得ない事情が生じた場合には、発注者の承諾を得て紙入札方式に変更することができるものとする。(６)電子調達システムに障害等のやむを得ない事情が生じた場合には、紙入札方式に変更する場合がある。10 入札執行中にあっては、入札辞退届又はその旨を明記した入札書を入札担当職員に直接提出して行う。12 入札の無効(１)入札公告に示した競争参加資格のない者が行った入札、申請書及び確認資料に虚偽の記載をした者が行った入札並びに別途示す入札閲覧書類及び関東森林管理局署等競争契約入札心得において示した入札に関する条件に違反した入札は無効とし、無効の入札を行った者を落札者としていた場合には落札決定を取り消す。なお、支出負担行為担当官等により競争参加資格のある旨確認された者であっても、開札の時において４に掲げる資格のないものは、競争参加資格のない者に該当する。(２)暴力団排除に関する誓約事項(別添１)について、虚偽又はこれに反する行為が認められた入札。13 落札者の決定方法(１)落札者の決定は、競争参加資格の確認がなされた者の中で、予決令第 79 条の規定に基づき作成された予定価格の制限の範囲内で、最低の価格をもって有効な入札を行った者を落札者とする。(２)予定価格が１千万円を超える契約について、落札者となるべき者の入札価格が予決令第 85 条に基づく調査基準価格を下回る場合は、14 に示すとおり、予決令第 86条の調査を行うものとする。(３)落札者が契約担当官等の定める期日までに契約書の取りかわしをしないときは、落札の決定を取り消すものとする。この場合、落札金額(入札書に記載した金額の100分の110に相当する金額)の 100 分の５に相当する金額を違約金として徴収するものとする。14 調査基準価格を下回った場合の措置(低入札調査)調査基準価格を下回って入札が行われた場合は、入札を「保留」とし、契約の内容が履行されないおそれがあると認めるか否かについて、入札者からの事情聴取、関係機関への意見照会等の調査を行い、落札者を決定する。調査基準価格に満たない価格をもって入札した者は、この調査に協力すべきものとする。この調査期間に伴う当該契約の履行期間の延期は行わない。15 契約書の作成等(１)競争入札を執行し、契約の相手方が決定したときは、契約の相手方として決定した日から遅滞なく別途示す契約書(案)により、契約を締結するものとする。(２)契約書を作成する場合において、契約の相手方が遠隔地にあるときは、まず、その者が契約書の案に記名して押印し、さらに、契約担当官等が当該契約書の案の送付を受けてこれに記名して押印するものとする。(３)(2)の場合において契約担当官等が記名して押印したときは、当該契約書の１通を契約の相手方に送付するものとする。(４)契約担当官等が契約の相手方とともに契約書に記名して押印しなければ本契約は確定しないものとする。16 支払条件前金払等の支払条件は別途示す契約書案によるものとする。17 関連情報を入手するための照会窓口上記５(2)イの受付場所と同じ。18 事業成績評定の実施請負契約の金額が、500 万円以上の事業については、「国有林野事業の素材生産及び造林に係る請負事業成績評定要領の制定について(平成 20 年３月 31 日付 19林国業第 244号林野庁長官通知)」に基づき成績評定を実施するものとする。なお、受注者が事業実行中、技術改革等に関する取組みを実施した場合、様式５－①「技術改革等に関する取組みの実施状況」を提出することができる。なお、具体的な内容の説明資料として写真等を添付すること。 19
