消費税法等の改正等によって消費税等の率に変動が生じた場合は、特段の変更手続を行うことなく、消費税等相当額を加減したものを契約金額とします。ただし、国が定める経過措置等が適用され、消費税等相当額に変動が生じない場合には、当該経過措置等の取扱いに従うものとします。 本件入札については、開札後に最低価格入札者に対し入札参加資格の確認を行います。 開札の結果、最低価格入札者であった者に契約担当課から連絡しますので、必ず開札日の翌日から2024年10月29日(火)午後5時までに、入札参加資格があることを証する書類を契約担当課に提出してください。 なお、入札参加資格があることを証する書類の受付時間は、休日を除く日の午前9時から午後5時までです(ただし、正午から午後1時までを除く。)。 上記提出期限までに、入札参加資格があることを証する書類の提出がない場合は、入札参加資格がないものとし、その者の行った入札は無効とするとともに、その者について競争入札参加停止を行います。この場合、1.の最低価格入札者の次に最低の価格を示した者(以下「次順位者」という。)について資格確認を行い落札決定を行います。この資格確認は落札者を決定するまで繰り返し行います。 提出された書類により審査を行った結果、入札参加資格を満たしていないと認められた者が行った入札は無効とします。この場合、1.の次順位者について資格確認を行い落札決定を行います。この資格確認は落札者を決定するまで繰り返し行います。 入札保証金は免除します。 本件入札において、代表者等と同一人である者の双方が入札したことが判明したときは、当該代表者等及び同一人である者のした入札は、京都市契約事務規則第6条の2第14号に基づきそれぞれ無効とするとともに、競争入札参加停止を行います。 本件入札により落札者を決定した場合において、契約を締結するまでの間に、落札者となった代表者等が、本件入札において入札した他の代表者等と同一人であったことが判明したときは、契約を締結せず、それぞれについて競争入札参加停止を行います。 落札決定日は、2024年11月05日とします。インターネットを利用して入札データを送信した入札参加者に対しては、落札結果を電子入札システムで確認するよう、電子メールを送信しますので、各自で確認してください。落札者が入札端末機を使用して入札データを送信していた場合には、2024年11月05日(火)午前10時以降に契約担当課担当者から落札者に電話連絡します。 契約日は、2025年4月1日となります。ただし、本件調達に係る予算が成立しない場合は、契約を締結いたしません。また、京都市の都合により、本件調達に係る予算を計上しない場合又は減額する場合があり、これらの場合においては、落札者と契約を締結しないこと又は契約締結前後において予定数量・金額等を大幅に削減することがあります。 業務内容本業務は、本市が指定する産業廃棄物収集運搬業者(以下、「収集運搬業者」という。)が、搬入する産業廃棄物(ただし、本市建設局が管理する排水機場(ポンプ場)に流着した塵芥等の産業廃棄物のうち、本市が収集運搬業者に引き渡したもの。以下同じ。)を「廃棄物の処理及び清掃に関する法律」(以下「廃棄物処理法」という。)及び関係法令に従い、処分を行うものである。2 契約期間令和7年4月1日~令和8年3月31日3 予定数量・ 31,000kg(ガラスくず、がれき類以外の産業廃棄物)・ 1,000kg(ガラスくず、がれき類)4 用語の定義本仕様書における用語の定義は、以下のとおりとする。(1)「処分業の許可」とは、廃棄物処理法第14条第6項に定める許可で、当該許可の許可証に記載されている事業の範囲に、汚泥、廃プラスチック類、金属くず、ガラスくず、がれき類が含まれているものをいう。(2)「塵芥等」とは、本市建設局が管理する排水機場(ポンプ場)に流着した塵芥等(汚泥(汚泥が付着した草、水草等を含む)、廃プラスチック類、金属くず、ガラスくず、がれき類)をいう。(3)「排水機場(ポンプ場)等」とは、別紙の10排水機場(ポンプ場)をいう。5 業務受注者の資格条件等(1) 本業務を受託しようとする者は、処分業の許可を京都市から受けていること。6 業務要領(1) 本業務受注者は、収集運搬業者が塵芥等を積み込む前に排水機場(ポンプ場)等にて本市職員と共に立会い、塵芥等を確認すること。(2) 本業務受注者は、収集運搬業者が搬入する塵芥等を検定証または基準適合証のある計量器にて重量を計量し、その重量を証明する書類を発行すること。(3) 産業廃棄物の処分は、5の(1)の許可証に記載された施設において行わなければならない。(4) 本業務受注者が当該産業廃棄物中間処理後の残さの最終処分の処分業の許可を有していない場合は、最終処分を当該産業廃棄物の処分業の許可を有している者に委託しなければならない。7 資格条件等の確認(1) 本業務受注者は、契約後直ちに、処分業の許可の許可証の写しを河川整備課に提出すること。(2) 本業務受注者は、当該産業廃棄物中間処理後の残さの最終処分を委託する場合は、委託先が有する最終処分の処分業の許可証の写し、並びに当該委託者に処分を委託していることが証明できる文書等(委託契約書の写し等)を河川整備課に提出すること。8 立入検査本業務受注者が本仕様書の定めのとおり業務を行っていることを確認するため、本業務受注者敷地内及びその他必要な場所に本市職員が立ち入り、検査ができるものとし、本業務受注者は、これを拒むことができない。9 報告・提出書類収集運搬業者が塵芥等の産業廃棄物を搬入するごとに、請求書、完了報告書及びその他指示するものを河川整備課に提出すること。提出書類の様式及び記入方法等については、河川整備課の指示があれば従うこと。また、当該産業廃棄物が適切に処分されていることを証明するため、産業廃棄物管理票(マニフェスト)を提出すること。10 本業務の履行に伴う損害、事故及び負傷等に関して、京都市は一切の責任を負わない。11 再委託の禁止本業務受注者は、本業務の全部又は一部を第三者に委託してはならない。ただし、6の(4)の委託は、この限りではない。12 権利・義務の譲渡の禁止本業務受注者は、本契約により生ずる権利又は義務を第三者に譲渡し、又は継承させてはならない。13 経費負担本業務の履行に伴う費用は、すべて受注者の負担とする。14 守秘義務本業務受注者は、本業務の履行に伴い知り得た事項を第三者に漏らしてはならない。15その他特記事項(1) 本業務の特徴は浸水防除のための排水機場(ポンプ場)に流着した塵芥等に係るものであり、気象・水象及びダムの放流量によって予定数量が大きく影響を受けるため、本市は、予定数量を保証しない。(2) 本契約を解除した場合、処分の完了していない当該産業廃棄物は、搬出元の排水機場(ポンプ場)堆積場まで運搬すること。(3) 落札業者は、本委託契約書を交わす際、受注者として仕様書の最終頁にある「産業廃棄物処分受注者記入欄」の項目について必ず記入し、受注者の許可証を添付すること。また、受注者が中間処理委託の場合は、中間処理の許可証の写しとともに最終処分地の許可証の写しを必ず添付すること。ただし、最終処分地の許可証の写しを添付できない場合は、契約書を交わす際、「産業廃棄物処分受注者記入欄」の最終処分地の項目(所在地、処理方法、処理能力等)を必ず記載すること。(4)
