次のとおり条件付一般競争入札(事後審査型)を行いますので、尾道市上下水道局契約規程(昭和41年水道部管理規程第17号)第26条に基づき公告します。 なお、本件は、広島県電子入札システム(以下「電子入札システム」という。)を利用して入札を行う電子入札案件であり、入札に関する手続きについては、尾道市上下水道局電子入札実施要領(以下「電子要領」という。)の適用があります。 入札に参加する者に必要な資格に係るすべての要件は、特別の定めがある場合を除き、開札日において満たしていなければならない。⑵ 入札に参加する者(特定建設工事共同企業体を対象に入札を行う場合は、入札に参加する特定建設工事共同企業体の構成員)は、次の要件をすべて満たしていなければならない。ア この公告の日から開札日までの間のいずれの日においても、本市の指名除外措置を受けていないこと。イ この公告の日から開札日までの間のいずれの日においても、建設業法(昭和24年法律第100号)第28条第3項又は第5項の規定による営業停止処分を受けていないこと。ウ 会社更生法(平成14年法律第154号)に基づいて更生手続開始の申立てがなされている者及び民事再生法(平成11年法律第225号)に基づいて再生手続開始の申立てがなされている者である場合にあっては、手続開始の決定がされていること。エ 元請施工実績とは、平成21年4月1日以降完了検査が終了している国、地方公共団体及び当該工事の発注当時において効力を有していた法人税法別表1に掲げる公共法人(地方公共団体を除く。)発注の工事をいうものとする。なお、「民間工事可」と記載されている場合の元請施工実績は、平成21年4月1日以降完了検査が終了している工事をいうものとする。⑷ 配置技術者の施工実績を問う場合においては、⑶の規定を準用するものとする。なお、監理技術者補佐として全ての期間従事した経験は、配置技術者の施工実績として認める。⑸ 入札に参加する者に必要な資格において建設業法第15条の許可(特定建設業許可)が否とされている工事であっても、下請代金の額によっては、建設業法第3条第1項の規定により特定建設業許可が必要となる場合がある。この場合には、建設業法第26条の規定により主任技術者にかえて監理技術者を配置しなければならない。⑹ 特定建設工事共同企業体の構成員としての施工実績を用いる場合は、20%以上の出資比率のものに限る。また、この場合、「請負金額、規模、その他入札参加資格に定めたもの(数値等)」は、全体の規模に出資比率を乗じたものを施工実績としてみなす。⑺ 工事成績評定点を問う場合においては、公告で指定する年度に完成検査を行った同種工事における、尾道市上下水道局工事成績評定要綱に基づく工事成績評定点(以下「評定点」という。)を対象とし、平均点とは、評定点の合計を、その件数で除したものとする。なお、特定建設工事共同企業体の構成員としての評定点は対象としない。2 入札方法等⑴ 入札参加者は、電子入札システムを利用して入札書を提出する。ただし、尾道市上下水道局電子入札実施要領(平成20年4月1日施行)で定める手続きを経て書面参加を行うこととした者は、書面による入札を行うことができる。⑵ ⑴の書面による入札を行う者は、指定した入札期間内に3桁のくじ番号を記載(くじ番号の記載のない場合は「001」と記載されたものとする。)した入札書を作成の上、次の事項を記載した封筒に封入して、持参により提出すること。ア 提出者の商号又は名称イ 入札書が在中している旨ウ 当該入札等に係る建設工事等の名称及び開札日⑶ 電報又は郵送による入札は、認めない。⑷ 次に掲げる場合は、その者の入札を無効とする。ア 公告に定める入札に参加する者に必要な資格のない者が入札を行ったとき。イ 入札に際しての注意事項に違反した入札を行ったとき。ウ 設計図書を受領していない者が入札を行ったとき。エ 尾道市上下水道局契約規程(昭和41年規程第17号)第32条第1項各号のいずれかに該当する場合⑸ 開札の結果、最低価格入札者を落札候補者として選定した後、落札者の決定を保留し、開札手続きを終了するものとする。その場合において、最低価格入札者が二人以上あるときは、電子入札システムによる電子くじを実施し、一人の落札候補者を選定するものとする。⑹ 開札の結果、予定価格の制限の範囲内の価格の入札がないとき(地方自治法施行令第167条の10第2項の規定により最低制限価格を設けた場合は、予定価格の制限の範囲内の価格で最低制限価格以上の入札がないとき)、又は、資格要件の確認の結果、入札を無効と決定された者を除いた入札者のうち、予定価格の制限の範囲内の価格の入札がないとき(地方自治法施行令第167条の10第2項の規定により最低制限価格を設けた場合は、予定価格の制限の範囲内の価格で最低制限価格以上の入札がないとき)は、尾道市上下水道局契約規程第33条の規定に基づき再度入札を行うものとする。⑺ 入札の回数は2回を限度とし、原則として1日で行うものとする。ただし、入札参加資格の審査において入札を無効と決定されたことにより再度入札を行うこととなった場合はこの限りでない。3 入札保証金免除する。4 工事費内訳書の提出⑴ 入札参加者は、入札の際に工事費内訳書を提出しなければならない(提出しない者は、当該入札を無効とする。)。⑵ 工事費内訳書の記載内容及び様式は別に指定する。⑶ 入札参加者は、その提出した入札書又は工事費内訳書を書き換え又は撤回することができない。5 資格要件確認書類の提出⑴ 開札手続きの終了後、落札候補者に対し、資格要件確認書類の提出を求めるものとする。⑵ 当該書類の提出を求められた落札候補者は、入札公告に定める提出書類を指定する期限までに提出しなければならない。⑶ 資格要件確認書類の提出を求められた者が次の各号に該当する場合には、その者は資格要件を満たしていないものとみなす。この場合においては、当該入札参加者に対し指名除外措置を行うことがある。ア 上下水道事業管理者が定める期限までに全ての資格要件確認書類の提出をしない場合イ 資格要件の確認のために契約担当課長が行った指示に従わない場合ウ 提出した資格要件確認書類によって資格要件を満たしていることが確認できない場合エ 提出した資格要件確認書類に虚偽の記載があった場合⑷ 提出された資格要件確認書類は、これを提出者に無断で使用しない。 ⑸ 入札を無効とする旨の通知を上下水道事業管理者から受けた者は、その理由の説明を求めることができる。6 技術者の取扱い⑴ 資格要件で技術者を「専任で配置できる者」とある場合においては、次の要件を満たすこと。ア 建設業法施行令第27条第2項が適用される工事を除き、他の工事の主任技術者等として配置されていないこと。イ 建設業法施行令第27条第2項が適用される工事にあっては、兼務する工事件数が本件工事を含めて2件以内であること。ただし、災害復旧工事を含む場合は、兼務する工事件数が本件工事を含めて3件以内であること。ウ 主任技術者等として管理する工事の施工場所(本件工事を除く。)は、全て尾道市内であること。(災害復旧工事は尾道市内要件を求めない。)エ 監理技術者に関し、監理技術者補佐を置く場合は、当該監理技術者の兼務する工事件数が本件工事を含めて2件以内であること。なお、監理技術者補佐の要件は、主任技術者要件を満たす者のうち、監理技術者の職務に係る基礎的な知識及び能力を有する者であること。(建設業法施行令第28条、29条関係)⑵ 資格要件で技術者を「専任で配置できる者」とない場合は、次のとおりとする。ア 請負金額500万円(税込み。以下請負金額について同じ。)未満(建築一式工事は1,500万円未満)の工事のみに配置する場合は、兼務できる件数に制限はないものとする。イ 本件工事又は現に技術者として従事中の工事のいずれかが請負金額500万円以上4,000万円未満(建築一式工事は請負金額1,500万円以上8,000万円未満)の工事である場合は、兼務できる件数は本件工事を含め5件までとする。(災害復旧工事は件数に含まない)ウ 営業所の専任技術者を兼務する場合は、金額にかかわらず兼務できる件数は4件までとする。(災害復旧工事は件数に含まない)⑶ 資格要件で「監理技術者の資格を有する者」とある場合は、監理技術者資格者証を有する者でなければならない。ただし、監理技術者資格者証と講習修了証を統合していない者については、両方を有する者であること。⑷ 配置予定技術者は、入札参加者と直接的かつ恒常的な雇用関係にある者でなければならない。なお、恒常的な雇用関係とは、開札日までに引き続き3か月以上の雇用関係にあることをいう。ただし、専任配置が要件とされていない工事(専任の要否については公告個別事項に記載している。)にあっては、恒常的な雇用関係を要しない。⑸ 配置予定技術者は、契約日時点で配置できる技術者を記載するものとする。なお、資格要件確認書類を提出する時に配置予定技術者を特定できない場合には、複数(3人を限度とする。)を記載することができる。⑹ 資格要件確認書類を提出する時において他の工事に従事中である技術者が公告に定める件数(6⑴及び⑵に定める件数)を超えて配置されることとなる場合は、次の場合に限り記載することを認めるものとする。ア 従事中の工事の契約工期の終期が開札日以降の場合であっても、完成検査が開札日の前日までに終了している場合イ 従事中の工事の契約工期の終期が開札日以降の場合であっても、完成検査を契約締結日までに行われることが決定している場合ウ 従事中の工事の契約工期の終期が開札日以降の場合であっても、開札日において完成検査が現場事務所の設置、資機材の搬入又は仮設工事等が開始されるまでに行われると見込まれる場合(要議決案件に限る)⑺ ⑹のイ又はウの場合であっても、その工事の完成検査が延期された場合には、配置予定技術者を配置することができないものとして指名除外措置を行うことがある。ただし、複数の配置予定技術者を記載した場合で、記載した他の技術者を配置可能である場合を除く。⑻ 資格要件確認書類の提出期限以降は、真にやむを得ない場合を除き、配置予定技術者の変更・差換え等は認めない。⑼ 落札後、配置予定技術者を配置することができない場合は、指名除外措置を行うことがある。⑽ 工場製作と現場施工を同一工事で行う場合で、工場製作のみが行われる期間と現場施工期間を区分できる場合には、工場製作のみが行われる期間と現場施工期間で途中交代するものとして、別の技術者を配置しても差し支えないものとする。その場合、資格要件確認書類のうち「技術者の資格・工事経験調書」は、それぞれの技術者について提出するものとする。なお、技術者を「専任で配置できる者」とある場合においては、現場施工について専任を義務付けるものとし、工場製作については「工場製作においても専任を要する」旨記載がある場合を除き、専任を義務付けない。⑾ 落札後、工事の施工に当たって、資格要件確認書類に記載した配置予定技術者を変更できるのは、病休、死亡又は退職等の極めて特別な場合に限る。⑿ 資格要件で、技術者を「専任で配置できる者」とある場合においては、入札の結果、請負金額が4,000万円(建築一式工事の場合は8,000万円)未満となる場合においても、契約工期中は当該技術者を専任で配置しなければならない。7 現場代理人の取扱い⑴ 現場代理人は入札参加者と直接的な雇用関係にある者でなければならない。⑵ 現場代理人は他の工事の現場代理人及び営業所の専任技術者であってはならない。ただし、監督員と携帯電話等で常に連絡がとれるなど、発注者との連絡体制を確保し、監督員等の求めにより速やかに工事現場に向かう等適切な対応が可能であって、次のアからカのいずれかに該当する場合は、他の工事の現場代理人との兼務を認める。 ア 施行場所が尾道市内の請負金額500万円未満の工事イ 技術者の専任配置を要しない工事で次の①から③の条件をすべて満たす場合において、受注者から書面で申請を行い、発注者の承認を得た場合① 請負金額500万円以上4,000万円未満(建築一式工事にあっては8,000万円未満)の公共工事であること② 兼務する工事件数が本件工事を含めて5件以内であること(災害復旧工事は件数に含まない)③ 兼務する工事が尾道市発注工事以外の公共工事である場合は、当該工事の発注者が兼務を承認したことを証する書面の写しを提出できること(広島県発注の災害復旧工事は不要)ウ 技術者の専任配置を必要とする工事(監理技術者が必要な工事は除く)のうち、次の①から③の条件をすべて満たす場合において、受注者から書面で申請を行い、発注者の承認を得た場合① 兼務する工事と密接な関係があり、兼務する全ての工事箇所の間隔が10㎞程度であること② 兼務する工事件数が本件工事を含めて2件以内であること。③ 兼務する工事が尾道市発注工事以外の公共工事である場合は、当該工事の発注者が兼務を承認したことを証する書面の写しを提出できること(広島県発注の災害復旧工事は不要)エ 災害復旧工事(技術者等の専任配置を必要とする工事を除く)オ 災害復旧工事(技術者等の専任配置を必要とする工事(監理技術者が必要な工事は除く))のうち、次の①から③の条件をすべて満たす場合において、受注者から書面で申請を行い、発注者の承認を得た場合① 兼務する工事と密接な関係があり、兼務する全ての工事箇所の間隔が15㎞程度であること② 兼務する工事件数が本件工事を含めて3件以内であること。③ 兼務する工事が尾道市発注工事以外の公共工事である場合は、当該工事の発注者が兼務を承認したことを証する書面の写しを提出できること(広島県発注の災害復旧工事は不要)カ 次のいずれかに該当する期間① 契約締結後、現場事務所の設置、資機材の搬入又は仮設工事等が開始されるまでの期間② 建設工事請負契約約款第20条第1項又は第2項の規定により、工事の全部の施工を一時中止している期間③ 橋梁、ポンプ、ゲート、エレベーター等の工場製作を含む工事であって、工場製作のみが行われている期間④ 工事現場が完了し、完成届提出後竣工検査までの期間⑤ その他、特に発注者が認めた期間8 落札者の決定方法⑴ 落札候補者の入札参加資格の審査を行い、その結果、資格要件を満たしていることが確認できるときは、その者を落札者として決定するものとする。⑵ 落札者の決定は、原則として開札時間の早いものから順に行うものとし、その際の配置予定技術者の専任要件は、入札公告における開札日時の早いものを優先することとする。⑶ 落札候補者が資格要件を満たしていることが確認できない場合は、その者の入札を無効とし、入札を無効と決定された者を除いた最低価格入札者から資格要件確認書類を提出させ、同様の審査を落札者が決定するまで行うものとする。⑷ ⑶の場合において、入札を無効と決定された者を除いた最低価格入札者が二人以上あるときは、電子入札システムによる電子くじを実施し、一人の落札候補者を選定するものとする。なお、入札を無効と決定された者を除いた入札者のうち、予定価格の制限の範囲内の価格の入札がないとき(地方自治法施行令第167条の10第2項の規定により最低制限価格を設けた場合は、予定価格の制限の範囲内の価格で最低制限価格以上の入札がないとき)は、再度入札を行うものとする。⑸ 落札者を決定した場合は、当該入札参加者に対して、その旨を通知するものとする。9 契約保証金請負代金額の100分の10以上を納付しなければならない。ただし、有価証券等の提供又は金融機関若しくは保証事業会社の保証をもって契約保証金の納付に代えることができる。また、履行保証保険証券又は公共工事履行保証証券の提出により、契約保証金の納付を免除する。10 経営事項審査の総合評定値通知書の写しの提出⑴ 落札者となった者は、契約(要議決案件は仮契約)を締結すべき日に、当該日の1年7か月前以降の日を審査基準日とする経営事項審査の総合評定値通知書の写しを提出しなければならない。⑵ ⑴の経営事項審査の総合評定値通知書の写しの提出を拒否した者については、この工事の請負契約を締結せず、また、指名除外措置の対象とする。⑶ ⑴の経営事項審査の総合評定値通知書の写しの提出をしないまま落札決定の日から7日を経過した場合も、原則として、⑵と同様とする。11 社会保険等未加入建設業者との下請契約⑴ 受注者は、原則として次に掲げる届出の義務を履行していない建設業者等(建設業法第2条第3項に規定する建設業者及び同法第3条第1項ただし書の政令で定める軽微な建設工事のみを請け負うことを営業とする者をいい、当該義務がない者を除く。以下「社会保険等未加入建設業者」という。)を下請契約(同法第2条第4項に規定する下請契約をいう。以下同じ。)の相手方としてはならない。ア C. The construction sites of the construction works managed as a chief engineer, etc. (excluding this construction work) must all be within Onomichi City. (The Onomichi City requirement does not apply to disaster recovery construction works.) D. In relation to the supervising engineer, if an assistant supervising engineer is appointed, the number of construction projects that the supervising engineer can handle concurrently must be no more than two, including this construction work. The requirements for an assistant supervising engineer are that, among those who meet the requirements for a chief engineer, they have the basic knowledge and ability related to the duties of a supervising engineer. (In relation to Articles 28 and 29 of the Construction Business Law Enforcement Order) (2) If the qualification requirements do not state that an engineer "can be assigned on a full-time basis", the following shall apply. If the person is only assigned to construction projects with a contract amount of less than 5 million yen (including tax; the same applies below to contract amounts) (less than 15 million yen for general construction work), there is no limit to the number of projects that the person can concurrently work on. B. If either this construction project or the construction project for which the person is currently working as an engineer has a contract amount of 5 million yen or more but less than 40 million yen (15 million yen or more but less than 80 million yen for general construction work), the number of projects that the person can concurrently work on is up to 5, including this construction project. (Disaster recovery construction projects are not included in the number of projects) C. If the person concurrently works as a full-time engineer at a sales office, the number of projects that the person can concurrently work on is up to 4, regardless of the amount. If the qualification requirements state that the person is "qualified as a supervising engineer," the person must be a person who has a supervising engineer qualification certificate. A permanent employment relationship means an employment relationship that has continued for at least three months by the date of opening of bids. However, in the case of construction work that does not require full-time assignment (whether full-time assignment is required is specified in the individual items of the announcement), a permanent employment relationship is not required. ⑸ The engineers to be assigned shall be those who can be assigned as of the contract date. If it is not possible to identify the engineers to be assigned at the time of submitting the qualification confirmation documents, multiple people (up to a maximum of three people) may be listed. ⑹ If engineers who are engaged in other construction work at the time of submitting the qualification confirmation documents will be assigned in excess of the number specified in the announcement (the number specified in 6(1) and (2)), it is permitted to list them only in the following cases. A: If the contract period of the work being engaged in is to end on or after the bid opening date, but the completion inspection has been completed by the day before the bid opening date. B: If the contract period of the work being engaged in is to end on or after the bid opening date, but the completion inspection has been determined to be conducted by the contract conclusion date.
