令和7年1月31日契約条件「旧地域リハビリテーション推進センターにおける産業廃棄物の処分業務」委託仕様書のとおり「旧地域リハビリテーション推進センターにおける産業廃棄物の処分業務」委託仕様書京都市(以下「発注者」という。)と、処分業者(以下「受注者」という。)は、発注者の事業(京都市中京区壬生仙念町30番地 旧地域リハビリテーション推進センター) から排出される産業廃棄物の処分に関して次のとおり行うものとする。第1条 (法の遵守)発注者及び受注者は、処理業務の遂行にあたって廃棄物の処理及び清掃に関する法律その他関係法令を遵守するものとする。第2条 (委託内容)(受注者の事業範囲)1 受注者の事業範囲は産業廃棄物処分であり、受注者はこの事業範囲を証するものとして、許可証の写しを発注者に提出し、本契約書に添付する。なお、許可事項に変更があったとき受注者は、速やかにその旨を発注者に通知するとともに、変更後の許可証の写しを発注者に提出し、本契約書に添付する。(委託する産業廃棄物の種類及び数量)2 発注者が、受注者に処分を委託する産業廃棄物の種類は以下のとおりである。また、各廃棄物の残置位置は別紙1、各廃棄物の残置状況は別紙2のとおりである。① 廃プラスチック ② 木くず ③ 繊維くず ④ ゴムくず⑤ 金属くず ⑥ ガラスくず、コンクリートくず及び陶器くず ⑦ がれき類(処理条件)3 受注者は、受け入れたものについては、可能な限りリサイクルすること。また、リサイクルに転用できなかったものについても、自ら適正に処理すること。(搬入業者)4 第2条第2項に定める廃棄物の処分場所への搬入は、発注者が別途契約する収集運搬事業者が行う。搬入の際、収集運搬事業者が発注者と契約した者であることを示す方法等については、契約後に別途協議のうえ決定する。第3条 (適正処理に必要な情報の提供)1 発注者は、産業廃棄物の適正な処理のために必要な以下の情報を、あらかじめ受注者に提供するほか、適宜又は受注者の要求に応じて、委託する産業廃棄物の適正処理に必要な情報を、受注者に提供すること。ア 産業廃棄物の発生工程イ 産業廃棄物の性状及び荷姿ウ 腐敗、揮発等性状の変化に関する事項エ 混合等により生ずる支障オ 日本工業規格C0950号に規定する含有マークが付された廃製品の場合には、含有マーク表示に関する事項カ その他取扱いの注意事項2 発注者は委託契約期間中、適正な処理及び事故防止並びに処理費用等の観点から、委託する産業廃棄物の性状等の変更があった場合は、受注者に対して速やかに書面をもってその変更の内容及び程度の情報を通知する。なお、受注者の業務に支障を生ずるおそれのある場合の、性状等の変動幅は、製造工程又は産業廃棄物の発生工程の変更による性状の変更や腐敗等の変化、混入の発生等の場合であり、発注者は受注者と通知する変動幅の範囲について、あらかじめ協議のうえ定めることとする。3 発注者は、委託する産業廃棄物のマニフェストの記載事項は正確にもれなく記載することとし、虚偽又は記載漏れがある場合は、受注者は委託物の引き取りを一時停止しマニフェストの記載修正を発注者に求め、修正内容を確認の上、委託物を引き取ることとする。4 発注者は、「産業廃棄物に含まれる金属等の検査方法」(昭和48年2月環境庁告示第13号)による試験を行う業務はない。第4条 (発注者受注者の責任範囲)1 受注者は、発注者から委託された産業廃棄物を、処分の完了まで、法令に基づき適正に処理しなければならない。2 受注者は発注者に対して、前項の業務の過程において法令に違反した業務を行い、または過失によって発注者又は第三者に損害を及ぼしたときは、受注者においてその損害を賠償し、発注者に負担させない。3 受注者が第1項の業務の過程において、受注者又は第三者に損害が発生した場合に、受注者に過失がない場合は発注者において賠償し、受注者に負担させない。第5条 (再委託の禁止)受注者は、発注者から委託された産業廃棄物の処分業務を他人に委託してはならない。ただし、発注者の書面による承諾を得て法令の定める再委託の基準にしたがう場合は、この限りではない。第6条 (義務の譲渡等)受注者は、本契約上の義務を第三者に譲渡し、又は承継させてはらならい。ただし、発注者の書面による承諾を得た場合にはこの限りではない。第7条 (委託業務終了報告)受注者は処分終了時にマニフェストD表を提出し、最終処分終了時に、マニフェストE表を提出するものとする。【産業廃棄物管理票提出先】〒604-8845京都市中京区壬生東高田町1番地の20保健福祉局地域リハビリテーション推進センター企画課TEL:075-925-5736第8条 (業務の一時停止)受注者は、やむを得ない事由があるときは、発注者の了解を得て、一時業務を停止することができる。この場合には、受注者は発注者にその事由を説明し、かつ発注者における影響が最小限となるよう努力する。第9条 (委託料・消費税・支払い)1 発注者の委託する産業廃棄物の処分業務に関する委託料について、消費税等の変動に伴う消費税率に変動が生じた場合は、変更契約を行うことなく消費税相当額を加減したものを契約金額とする。2 委託料の額が経済情勢の変化及び第3条第2項等により不相当となったときは、発注者受注者双方の協議によりこれを改定することができる。3 発注者は、本委託業務完了後に、受注者の請求により委託料を速やかに支払うものとする。第10条 (内容の変更)発注者又は受注者は、必要がある場合は委託業務の内容を変更することができる。この場合において、契約単価又は契約期間を変更するとき、又は予定数量に大幅な変動が生ずるときは、発注者と受注者で協議のうえ、書面によりこれを定めるものとする。第3条第2項の場合も同様とする。第11条 (機密保持)発注者、受注者は、本契約に関連して、業務上知り得た相手方の機密を第三者に漏らしてはならない。当該機密を公表する必要が生じた場合には、相手方の文書による許諾を得なければならない。第12条 (契約の解除)1 発注者及び受注者は、相手方が本契約の各条項のいずれかに違反したときは、書面による催告のうえ、相互に本契約を解除するこができる。 2 受注者は、相手方が反社会的勢力(暴力団等)である場合又は密接な関係がある場合は、相互に催告することなく、本契約を解除することができる。3 発注者又は受注者から契約を解除した場合においては、本契約に基づいて発注者から引き渡しを受けた産業廃棄物の処理が未だに完了していないものがあるときは、受注者又は、発注者は、次の措置を講じなければならない。(1) 受注者の義務違反により発注者が解除した場合ア 受注者は、解除された後も、その産業廃棄物に対する本契約に基づく受注者の業務を遂行する責任は免れないことを承知し、その残っている産業廃棄物についての処分の業務を自ら実行するか、もしくは発注者の承諾を得たうえ、許可を有する別の業者に自己の費用をもって行わせなければならない。イ 受注者が他の業者に委託する場合に、その業者に対する報酬を支払う資金がないときは、受注者はその旨を発注者に通知し、資金のないことを明確にしなければならない。ウ 上記イの場合、発注者は当該業者に対し、差し当たり、発注者の費用負担をもって受注者のもとにある未処理の産業廃棄物の処分を行わせるものとし、その負担した費用を、受注者に対して償還を請求することができる。(2) 発注者の義務違反により受注者が解除した場合受注者は発注者に対し、発注者の義務違反による損害の賠償を請求するとともに、受注者のもとにある未処理の産業廃棄物を、発注者の費用をもって引き取ることを要求し、もしくは受注者自ら発注者方に運搬したうえ、発注者に対し当該運搬の費用を請求することができる。第13条 (協議)この契約に定めのない事項又はこの契約の各条項に関する疑義が生じたときは、関係法令に従い、その都度発注者、受注者が誠意をもって協議しこれを取り決めるものとする。第14条 (契約期間)契約の日から令和7年1月31日までの、月曜日から金曜日までの開庁日の9時から17時までに実施すること。詳細については、別途協議のうえ決定する。第15条 (現地下見)下見については、公告開始日から3開庁日後までに予約し、時間の指定を受けたうえで、指定された時間に旧地域リハビリテーション推進センターに来ること。予約のない業者及び指定された時間を厳守しない業者については、下見を断る場合がある。なお、下見を行わずに入札に参加することは差し支えない。下見場所(現地):京都市中京区壬生仙念町30番地旧地域リハビリテーション推進センター下見日程
