(3) Cost burden The costs required for the preparation of the application and attached documents shall be borne by the bidder. (4) If there are any defects in the application for confirmation of eligibility to participate or the attached documents and it is not possible to determine whether or not a bidder is eligible to participate, the bidder shall not be recognized as eligible to participate. 5 Decline to participate in a bid In addition to the following, it shall be subject to the provisions of Article 7 of the Participant's Guidelines (decline to participate in a bid). (1) Freedom of withdrawal: A person who has applied to participate in the bid under 4 above (limited to advance applications prior to the bid) or who has received a notice of nomination and does not wish to participate in the bid may withdraw his/her bid at any time up until the submission deadline, and will not be disadvantaged in future bids for that reason. (2) Withdrawal after submission of bid document: Notwithstanding the provisions of (1) above, a bidder cannot withdraw his/her bid document after submitting it. However, only in the case of postal bidding, a bidder may withdraw his/her bid by submitting a notice of withdrawal of bid directly to the bidder by the bid opening date and time specified in the bid announcement, etc. (3) Method of withdrawal: As provided for in Article 7 of the Participant's Guidelines. However, this does not apply in the case of the proviso in (2) above. 6 Cancellation of bid, etc.: A bid with no bidders will be cancelled and will be subject to the provisions of Article 13 of the Participant's Guidelines (Cancellation of bid, etc.). 7. Execution of the bid (1) The amount stated in the bid document When determining the successful bid, the successful bid price shall be the amount stated in the bid document plus 10/100 of the said amount (if the amount has a fraction of less than 1 yen, the fraction shall be rounded down). Therefore, regardless of whether the bidder is a taxable entity or an exempt entity with respect to consumption tax and local consumption tax, the bidder must state in the bid document an amount equivalent to 110/100 of the estimated desired contract amount (including the amount equivalent to consumption tax). (2) Method of submitting the bid document The bid document shall be in the format specified by Yamaguchi City, and bids by mail or telegraph are not permitted, except for postal and electronic bids. (3) Rewriting the bid document, etc. After submitting the bid document, it cannot be rewritten, exchanged, or retracted under any circumstances. However, this does not apply in the case of the proviso in 5(2) above. (4) Proxy bidding If you wish to have an agent perform an act related to the bid, you must submit a power of attorney. (5) Single bidder a. In open competitive bidding, the bid will be executed even if there is only one bidder. However, if there is only one bidder in the re-bidding, the bid will be cancelled. b. In designated competitive bidding, if there is only one bidder due to withdrawal or other reasons, the bid will be cancelled. Repeated Bidding (1) Pursuant to Articles 17 (Repeated Bidding) and 18 (Restrictions on Participation in Repeated Bidding) of the Participant Guidelines. The total number of times that a bidder may bid again, including the initial bid, is limited to three. (2) In the case of at-venue bidding, bidders must prepare at least three copies of the bid documents in anticipation of a repeat bid. 9. Invalid Bids (1) Pursuant to Article 11 (Invalid Bids) of the Participant Guidelines. (2) In the case of designated competitive bidding, bids submitted by persons who do not meet the requirements set forth in (1) to (3) of "1. Competitive Bidding Guidelines, etc." above will be invalid. 10. Detailed Bidding SheetIf the bid announcement, etc. requires the submission of a detailed bidding sheet, the details will be submitted in accordance with Article 9 (Submission of Bid Documents, etc.) of the Participant Guidelines. 11. Method of determining successful bidder (1) Determination of successful bidder The successful bidder will be the person who submitted the lowest valid bid within the limit of the estimated price. (2) Persons who will not be successful bidders The following persons will not be successful bidders. A. Persons who submitted bids that are invalid as described in 9 above. B. Persons who will not be successful bidders as provided for in Article 16, paragraph 1 of the Participant Guidelines. C. Persons who have been found to have ties with organized crime groups, etc., based on information provided by the Yamaguchi Prefectural Police, etc. D. Other persons who the Mayor deems extremely inappropriate to enter into a contract with, as they may disrupt the order of fair transactions. (3) Determination by lottery In the event that a lottery is held due to the same amount of bids, the procedure will be as provided for in Article 19 of the Participant Guidelines (Determination of successful bidder when there are two or more bidders with the same amount that should be the successful bidder). 12. Conclusion of contract, etc. (1) If, after the successful bidder is determined, but before the contract is concluded, the successful bidder no longer meets the qualifications required for those who can participate in the bidding, no contract will be concluded with that successful bidder. (2) If the tender announcement, etc. specifies that electronic contracting may be used, a successful bidder who wishes to use electronic contracting must submit an "Application for Use of Electronic Contracting" in accordance with the instructions for "Application for Use of Electronic Contracting" posted on the official website of Yamaguchi City.
