The DepEd, Schools Division of Camarines Sur, through the SUB-ARO OSEC-5-23-0681 (CONTINUING FUND SBFP 2023), SUB –ARO 5-24-0495 (CURRENT FUND), and SUB-ARO 5-23-0370 (CONTINUING FUND 2023) intends to procure the SUPPLY AND DELIVERY OF MEDICINES FOR DENTAL AND MEDICAL OFFICE – NEGOTIATED PROCUREMENT AFTER TWO FAILED BIDDINGS as Project No. 2024-09-042 with an Approved Budget for the Contract (ABC) of NINE HUNDRED TWENTY-FIVE THOUSAND NINE HUNDRED PESOS ONLY (P925,900.00) Lot No. Description ABC 1 SUPPLY AND DELIVERY OF MEDICINES FOR DENTAL AND MEDICAL OFFICE – NEGOTIATED PROCUREMENT AFTER TWO FAILED BIDDINGS P925,900.00 2. The DepEd, Schools Division of Camarines Sur now invites technically, legally and financially capable suppliers for the said project. 3. The Procurement procedure for this requirement is Negotiated Procurement - Two-Failed Bidding pursuant to Section 53.1 of 2016 revised Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9184. The selection of the successful offer shall be based on the best and final offer that will be submitted on the set deadline by the BAC and which would meet the minimum technical specifications required. 4. Prospective Suppliers may obtain further information from DepEd Schools Division Office of Camarines Sur (Procurement Office) at the address given below from October 21-29, 2024 Monday to Friday, 8:00 a.m. to 4:00 p.m., EXCEPT during HOLIDAYS. 5. The DepEd, Schools Division of Camarines Sur will hold a Negotiation Conference on October 28, 2024, 1:00 p.m. at Procurement Office, Freedom Sports Complex, San Jose, Pili, Camarines Sur which shall be open to prospective suppliers. 6. Three (3) copies of the proposals (one original and two photocopies) must be submitted to the BAC which must be duly received by the BAC Secretariat through manual submission at the office address indicated above on or before 9:00 AM of October 29, 2024. Late submission shall not be accepted. 7. Interested suppliers shall submit the following documents in sealed envelopes, labeled as “Negotiated Procurement for Two-Failed Biddings”, with the title of the procurement project, name of the bidder, address, the contact details of the bidder, addressed to the BAC. Eligibility and Technical Documents a. Valid PhilGEPS Registration Certificate (Platinum Membership) (all pages) in accordance with Section 8.5.2 of the IRR; b. Mayor's/Business Permit c. DTI/ SEC Registration d. Tax Clearance e. Audited Financial Statement f. Income/Business Tax Return g. BIR Registration 2303 h. Technical Specifications i. Schedule of Requirements j. Request for Quotation Other Required Documents during opening of bids: a. License to Operate (LTO) from Food & Drug Administration (FDA) with list of sources (DOH AO No.2014-34 dtd 10/13/14) (for Medicines & Drugs) b. Certificate of Good Manufacturing Practice (CGMP) issued by FDA, if the Supplier is a Manufacturer Other Required Documents before the delivery: c. Certificate of Product Registration (CPR) from FDA, Manufacturer(s), reconciled w/ list of Sources in LTO for every medicine/drug delivered, DOH AD No. 2014-34, d. If the supplier is not the manufacturer, certification from the manufacturer that the supplier is an authorized distributor/dealer of the product/items e. Copy of contract between the Supplier & his source/distributorship agreement f. Batch Release Certificate from FDA g. Batch Certificate for Antibiotics (BCA) h. Delivery Receipts (DR) / Invoices bearing Lot No. and Expiry Date For the purpose of constituting a quorum, both the physical and virtual presence of the BAC members shall be considered pursuant to GPPB Resolution No. 09-2020. 8. The Winning Supplier shall post a Performance Bond five percent (5%) in the form of Cash, Cashier‘s check, Manager’s check, Bank draft/guarantee confirmed by a universal or Commercial Bank or Irrevocable letter of credit issued by a Universal or Commercial Bank or thirty percent (30%) in case of Surety Bond. And shall provide a Bank Account for payment preferably a Land Bank account. 9. The DepEd, Schools Division of Camarines Sur reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Sections 35.6 and 41 of the 2016 revised IRR of RA No. 9184, without thereby incurring any liability to the affected bidder or bidders. 10.
