Whereas, BAC Resolution Nos. 24-034, 24-059 and 24-061 were issued declaring 1st failure of bidding for the said items where the prospective bidder declared post-disqualified; Whereas, BAC Resolution No. 24-113 was issued declaring 2nd failure of bidding for the said items where the prospective bidder declared post-disqualified and recommending the use of negotiated method of procurement pursuant to Section 53.1 of the Revised Implementing Rules and Regulation of R.A. 9184; Whereas, mandatory review of 2nd failure of bidding of the above project were conducted on May 13, 2024 to determine the reasons and causes of the 2nd failure of bidding; Whereas, BAC Resolution No. 24-013-Negotiated was issued declaring 3rd failure of bidding for the said item under BFO No. 24-013 negotiated method of procurement pursuant to Section 53.1 of the Revised Implementing Rules and Regulation of R.A. 9184 where the prospective bidder did not submit proposal; Whereas, mandatory review of failure of bidding of the above project were conducted on June 27, 2024 to determine the reasons and causes of the 3rd failure of bidding Whereas, by virtue of above resolutions the BAC now invites interested suppliers for the Best and Final Offer of the hereunder project; Item/Description Approved Budget for the Contract (ABC) Supply and Delivery of Various Medicine (7 Line Items – Framework Agreement) Php 8,697,893.60 The schedules of best and final offer activities are as follows: ACTIVITIES SCHEDULE Advertisement / Posting of Invitation to Bid July 3, 2024 Issuance and Availability of Bid Documents July 3, 2024 onwards, 8:00 am to 12:00 noon Negotiation with the suppliers July 9, 2024 (Tuesday) 2:00 PM Opening of Best and Final Offer July 12, 2024 (Friday) 2:00 PM Please submit your best proposal/quotation in Three (3) sets ELIGIBILITY AND TECHNICAL DOCUMENTS ARRANGED, NUMBERED, TABBED AND SOFT BOOK BINDED BLUE FOLDERS (1 ORIGINAL and 2 COPIES) and Three (3) sets FINANCIAL DOCUMENTS ARRANGED, NUMBERED, TABBED AND SOFT BOOK BINDED YELLOW FOLDERS (1 ORIGINAL and 2 COPIES) on or before July 12, 2024, (Friday) at the G/F BAC Conference Room, NKTI Main Building at 2:00 P. M. with the following requirements: CONTENTS OF ELIGIBILITY AND TECHNICAL BLUE FOLDER (1) Duly accomplished and signed Technical Specification provided; (2) Duly accomplished and signed General Conditions of Contract; (3) Duly accomplished and signed Special Conditions of Contract; (4) Duly accomplished and signed Schedule of Requirements and the Framework Agreement List provided; (5) Duly signed and notarized OMNIBUS AFFIDAVIT in accordance with Section 25.2(a)(iv) of the IRR of RA 9184 and using the prescribed form (Please see attached) (6) Legal Documents: a. Valid PhilGEPS Registration Certificate (Platinum Membership) (all pages). (7) Technical Documents: a. Statement of the prospective bidder of all its ongoing government and private contracts, including contracts awarded but not yet started, if any, whether similar or not similar in nature and complexity to the contract to be bid. b. Statement of the bidder’s Single Largest Completed Contract (SLCC) similar to the contract to be bid, except under conditions provided for in Sections 23.4.1.3 and 23.4.2.4 of the 2016 revised IRR of RA No. 9184, within the relevant period as provided in the Bidding Documents. The Bidder must have completed within the past three (3) years a single contract similar to this project, equivalent to at least twenty-five percent (25%) of the ABC prior to the deadline for the submission and receipt of bids. For this purpose, contracts similar to the Project shall be Various Medicines. (8) Financial Documents: a. The prospective bidder’s duly signed computation of Net Financial Contracting Capacity (NFCC) OR a committed Line of Credit from a Universal or Commercial Bank in lieu of its NFCC computation. CONTENTS FINANCIAL YELLOW FOLDER: (1) Original of duly signed and accomplished Financial Bid Form (2) Original of duly signed and accomplished Price Schedule(s). a. Price Schedule for Goods Offered from Abroad; OR b. Price Schedule for Goods Offered Within the Philippines AND c. Price Schedule (attached as Annex A) The National Kidney and Transplant Institute reserves the right to accept or reject any proposal, to annul the process, and to reject all the same at any time prior to contract award, without thereby incurring any liability to the affected suppliers.
