The description of an eligible bidder is contained in the Bidding Documents, particularly, in Section II, Instruction to Bidders. Bidding will be conducted through open competitive bidding procedures using a non-discretionary “pass/fail’ criterion as specified in the Implementing Rules and Regulations of Republic Act 9184, otherwise known as the “Government Procurement Reform Act”. Bidding is restricted to Filipino citizens/sole proprietorship, partnership, or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to the citizens of the Philippines, and to citizens or organizations of a country the laws or regulation of which grant similar rights or privileges to Filipino citizens, pursuant to RA 518, and subject to Commonwealth Act 138. Prospective bidders should have experience in undertaking a similar project within the last two (2) years, with an amount of at least 50% of the proposed project for bidding. We shall require that the prospective supplier/bidder should be: (1) At Least TWENTY (20) YEARS OF EXPERIENCE IN SELLING BRAND NEW HEAVY EQUIPMENT AND TRUCKS as certified by the company where the firm started from the SEC registration date with track record; must have a (2) CERTIFICATE OF REGISTRATION from the BUREAU OF CUSTOMS; must have a (3) CERTIFICATE OF PHILGEPS REGISTRATION UNDER PLATINUM MEMBERSHIP; must have a (4) CERTIFICATE OF ACCREDITATION as IMPORTER/DEALER from LAND TRANSPORTATION OFFICE; must have an (5) AUDITED FINANCIAL STATEMENTS with INCOME and BUSINESS TAX RETURNS filed and paid through the BIR Electronic Filing and Payment System (EFPS) for the year 2023; (6) Unexpired BIR TAX CLEARANCE; (7) The SUPPLIER/BIDDER must conduct seminars and trainings for the Operators and Mechanics on Preventive Service, Safety Rules and Standard Operating Procedures; (8) The SUPPLIER/BIDDER must issue a CERTIFICATE OF WARRANTY for a period of one (1) year for Brand New Heavy Equipment; (9) The Brand New Heavy Equipment must be delivered up to the Local Government Unit of Opol; (10) The SUPPLIER/BIDDER must issue a CERTIFICATE OF AVAILABILITY OF AFTER SALES SERVICES and must have a showroom.
