No. 9184, all procurement shall be done through Competitive Bidding, except as provided for in Article XVI of this Act. WHEREAS, Article XVI particularly Section 48 provides alternative methods and states that subject to the prior approval of the Head of the Procuring Entity or his duly authorized representative, and whenever justified by the conditions provided in this Act, the Procuring Entity may, in order to promote economy and efficiency, resort to any of the alternative methods of procurement. WHEREAS, chronic kidney disease is now the 7th cause of mortality in the Philippines affecting approximately 120 persons per million populations per year and these statistics keep on growing with each year. These data gathering was done using validated questionnaire developed by Wright et.al (2018); WHEREAS, people with kidney disease for many years, or if their kidneys have suddenly failed because of disease or injury, their doctor may recommend the patient to undergo dialysis; WHEREAS, dialysis is a treatment that replaces some of what the kidneys do, removing waste and excess fluid from their blood; WHEREAS, construction of a government funded dialysis center in Ibaan is necessary; WHEREAS, Purchase Request dated October 21, 2024 for the supply and delivery of food is attached thereto; WHEREAS, under section 53.9 of the IRR of RA 9184 defines small value procurement as procurement of goods, infrastructure projects and consulting services, where the amount involved does not exceed the threshold prescribed in Annex "H" of the IRR: provided, that in case of goods, the procurement does not fall under shopping in Section 52 of this IRR. WHEREAS, the said Annex “H” of IRR of RA 9184 further defines the small value procurement of (a) goods not covered by Shopping under Section 52 of the IRR of RA 9184, (b) infrastructure projects, and (c) consulting services, where the amount involved does not exceed Two Hundred Thousand Pesos (P200,000.00); WHEREAS, the approved budget for the Supply and Delivery of Food, Dialysis Center Groundbreaking Ceremony, MHO, Municipality of Ibaan, Batangas is Fifty-Six Thousand Pesos Only (P56,000.00). NOW THEREFORE, we the members of the BIDS and AWARDS COMMITTEE, RESOLVED as it is hereby RESOLVED to recommend small value procurement as an alternative method of procurement under section 53.9 of the IRR of RA 9184 for the supply and delivery of food.
