The AGRICULTURAL TRAINING INSTITUTE-REGIONAL TRAINING CENTER MIMAROPA, through the 2024 General Appropriations Act (GAA) intends to procure FOOD AND CATERING SERVICES with an Approved Budget for the Contract (ABC) of One Million Forty-Six Thousand Seven Hundred Fifty Pesos (Php 1,046,750.00). 2. The ATI-RTC MIMAROPA Bids and Award Committee (BAC) now invites technically, legally, and financially capable suppliers for the mentioned goods and services. 3. The Procurement procedure for this procurement project is Negotiated Procurement due to Two-Failed Bidding pursuant to Section 53.1 of 2016 revised Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9184. The selection of successful offer shall be based on the best and final offer that will be submitted on the set deadline by the BAC and which could meet the minimum technical specifications required. 4. The interested bidders may obtain further information from the BAC Secretariat at the ATI-RTC MIMAROPA, Barcenaga, Naujan Oriental Mindoro from July 10 to 17, 2024, Monday to Friday, at 8:00AM to 5:00PM. 5. The schedule of Negotiated Procurement activities is herein stated below; ACTIVITIES SCHEDULE 1.Negotiation Meeting July 12, 2024; 11:00AM 2. Deadline of Submission of Bid July 17, 2024; 10:00AM 3.Opening of Bids July 17, 2024; 10:00AM 4.Post Qualification July 23, 2024; 10:30AM 6. Two (2) copies of the proposals (one original and one photocopy) must be submitted to the BAC which must be duly received by the BAC Secretariat through manual submission at the office of ATI-RTC MIMAROPA, Barcenaga, Naujan Oriental Mindoro. Late submission shall not be accepted. 7. Bids shall be submitted in Sealed envelope, labeled as “Negotiated Document” with the title of the procurement project, name of the bidder, address of the bidder, and contact details of the bidder, addressed to Ms. Cristina G. Magnaye, MPM-RD, BAC Chairman or Director Pat Andrew B. Barrientos, M.M, J.D, Center Director. A. Eligibility and Technical Documents a) Valid PhilGEPS Registration Certificate (Platinum Membership), including the Attachments; Attachment A - SEC/DTI/CDA Registration Certificate: • For corporations, partnerships, and cooperatives, this would be the Securities and Exchange Commission (SEC) Registration Certificate. • For sole proprietorships, the Department of Trade and Industry (DTI) Business Name Registration. • For cooperatives, the Cooperative Development Authority (CDA) Registration Certificate. Attachment B - Mayor’s/Business Permit: • A copy of the current Mayor’s Permit or Business Permit issued by the city or municipality where the principal place of business of the bidder is located. Attachment C- Tax Clearance Certificate: • A Tax Clearance Certificate issued by the Bureau of Internal Revenue (BIR) confirming that the bidder has no outstanding tax liabilities. Attachment D - Audited Financial Statements: • A copy of the bidder’s latest audited financial statements, which must be stamped "received" by the BIR or its duly accredited and authorized institutions. Attachment E - Statement of All Ongoing Government and Private Contracts: • A statement listing all ongoing government and private contracts, including contracts awarded but not yet started, whether similar or not similar in nature and complexity to the contract to be bid. Attachment F - Net Financial Contracting Capacity (NFCC): • A computation of the bidder’s Net Financial Contracting Capacity (NFCC) or a credit line certificate from a reputable bank. b) Statement of Bidder’s Single Largest Completed Contract (SLCC) similar to the contract to bid. For this purpose, the definition of similar contracts shall refer to Supply of Food and Catering Services which shall be completed within the last five (5) years prior to the date of submission of the best and final offer. c) Bid security in any of the following form as prescribed under the 2016 revised IRR of RA 9184: i. In case of cash, Manager’s Check, Bank Guarantee (2% of the ABC of Php 20, 935.00) ii. In case of Surety Bond, submit also a certification issued by the Insurance Commission or Original Copy Notarized Bid Securing Declaration (5% of the ABC or Php 52,337.50) iii. Bid Securing Declaration d) Conformity with the Schedule of Requirements (Annex “A”); e) Conformity with the Technical Specifications (Annex “B”); f) Notarized Omnibus Sworn Statement (OSS) supported with Notarized Secretary’s Certificate in case of a corporation or cooperative; in case of partnership or single proprietorship, the bidder shall submit Special Power of Attorney executed by the partners or single proprietorship; whichever is applicable. In case of Joint Venture, Special Power of Attorney shall be submitted by all members of the joint venture giving full power and authority to its officer to sign the OSS and do acts to represent the Bidder. g) If applicable, a duly signed joint venture agreement (JVA) in case the joint venture is already in existence or duly notarized statement from all the potential joint venture partners stating that they will enter into and abide by the provisions of the JVA in the instance that the bid is successful. B. Financial Documents h) Bid Form i) Price Schedule 8. The Special Conditions of the Contract (Annex “C”) shall form part of the contract. Other conditions of the contract shall be governed by the implementation of the rules and regulations of RA 9184 and other related and applicable laws. 9. The Head of the Procuring Entity reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract in accordance with Section 41 of RA 9184 and it’s 2016 revised Implementing Rules and Regulations without thereby incurring any liability to the affected bidder of bidders.
