The Authority of the Freeport Area of Bataan (AFAB) through its Bids and Awards Committee (BAC) invites contractors to apply for eligibility and to participate in the negotiated procurement for the above-mentioned project in accordance with the Revised Implementing Rules and Regulations (RIRR) of Republic Act (RA) 9184, otherwise known as the “Government Procurement Reform Act”. 2. The AFAB reserves the right to declare a failure of bidding if the funds/allotments for the project have been withheld or reduced through no fault of the procuring entity. 3. For the Virtual Negotiation: 4.1. All interested bidders must send the following details to the BAC Secretariat at bac.secretariat@afab.gov.ph on or before 3 PM of 14 October 2024: a. The authorized representative/s of the prospective bidders will be provided by the BAC Secretariat with the Google Meet Link after receipt of the attendance confirmation based on the details provided above. Only the official representatives indicated in the email will be allowed to enter the Google Meet room. 4.3. The authorized representative/s should make themselves available 10 minutes before the start of the Pre-Bid Conference and rename their google meet display following the format: COMPANY NAME_Full Name of representative 4.4. All prospective bidder’s representative will be muted at the start of the pre-bid conference and will be given time to raise their questions for every section of the discussion. 4.5. The authorized representative/s is/are allowed to type their questions/inquiries in the chat box. Upon acknowledgement of the BAC Secretariat, they will be unmuted and thereafter state their name/s and company before asking a question or commenting. 5. A complete set of Bidding Documents may be purchased by interested Bidders upon payment of a non-refundable fee in the amount specified above either by actual payment at the AFAB Cashier or via bank deposit. For bank transfer or deposit, send an email to bac.secretaria@afab.gov.ph. 5.1 It may also be downloaded free of charge from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of AFAB (afab.gov.ph), provided that bidders shall pay the applicable fee for the Bidding Documents not later than the submission of their bids. 6. Deadline of submission of bids is stated above. Late bids shall not be accepted. All Bids must comply with the requirements of the RIRR, the Bidding Documents and all other requirements prescribed by the BAC. 7. Bidding will be conducted through open competitive bidding procedures using a non-discretionary “pass/fail” criterion as specified in the 2016 RIRR of RA 9184. 8. Bidding is restricted to Filipino citizens/sole proprietorships, partnerships, or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws or regulations of which grant similar rights or privileges to Filipino citizens, pursuant to RA 5183. 9. Bids received in excess of the ABC for each lot shall be automatically rejected at bid opening. Completion of the Works is required as indicated in the contract duration. Bidders should have completed a contract similar to the Project as indicated in the Bidding Documents. The description of an eligible bidder is contained in the Bidding Documents. 10. The BAC shall evaluate all bids on an equal footing to ensure fair and competitive bid comparison. For this purpose, all bidders shall be required to include the cost of all taxes, such as, but not limited to, 12% value added tax (VAT), income tax, local taxes, and other fiscal levies and duties which shall be itemized in the bid form and reflected in the detailed estimates. Such bids, including said taxes, shall be the basis for bid evaluation and comparison. 11. During post-qualification, projects listed in the Statement of All Ongoing Government and Private Contracts, Including Contracts Awarded but Not Yet Started and SLCC will be verified based on the Section 34 of the 2016 Revised IRR of RA 9184. 12. The AFAB reserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without thereby incurring any liability to the affected Bidder or Bidders. 13.
