Once the cumulative amount of liquidated damages reaches 10% of the total amount of the items ordered the procuring entity may cancel the Purchase Order * Supplier must submit Sales Invoice together with the request for payment every after delivery. PAYMENT TERMS: * Payment shall be made within 60 days from the completion of all deliveries per line in the Purchase Order and upon submission and completion of all documentary requirements. Other Requirements: 1. Valid and current Certificate of Product Registration (CPR) issued by the FDA. IF CPR is expired, certified true copy of Official receipt and tracking document from FDA 2. License To Operate for drug suppliers, distributors and traders issued by the FDA as per RA 9711 (FDA Act of 2009) and its IRR and DOH AO No. 2016-003. Requirement for Inspection and Delivery: 1. Shelf life should be not less than 18 months at the time of delivery. Supplier should specify the date of expiration and should be willing to replace unconsumed drugs and medicines at least three (3) months prior to expiry date. 2. Cold chain should be observed in the transport of temperature-sensitive drugs and medicines. They should be delivered to the Materials Management Department (MMD) in tightly sealed containers packed with cooling devices. Deliveries not within the required temperature shall be returned to the supplier immediately upon verification at the MMD. 3. Upon delivery, drugs and medicines with physical signs of degradation such as discoloration of tablets, capsules, solutions and powder for reconstitution, chips, cracks in tablets, crushed capsules, caking in suspensions and moisture droplets in vials of dry powder shall be returned to and replaced by the supplier at no additional cost to the hospital, Likewise, drugs and medicines with packaging that have signs of damage or deterioration shall be returned to the supplier. 4. Deliveries may be subjected to test analysis by the FDA. Quantities subjected for test analysis should be replaced and the payment/processing fee should be paid by the winning bidder. In case of failure of test analysis, award of the said item shall be cancelled and procurement shall be made to the next lowest complying bidder. 5. Each item should be labelled in accordance with the provisions of DOH Administrative Order No. 2016-0008 dated 21 March 2016.
