Wykonawca gwarantuje, że przy realizacji dostaw, usług i robót budowlanych zaoferowany przedmiot zamówienia lub wykorzystane materiały są zgodne z opisem przedmiotu zamówienia oraz spełniają wymagania wynikające z przepisów prawa. 9. W przypadku realizowania dostawy niezgodnie z opisem przedmiotu zamówienia oraz ze złożoną przez Wykonawcę ofertą, KWP w Kielcach zwróci niezgodny przedmiot zamówienia na koszt i ryzyko Wykonawcy. 10. KWP w Kielcach wybierze ofertę najkorzystniejszą, zgodnie z określonymi w postępowaniu kryteriami wyboru oferty. 11.
