Selection criteria Sources of selection criteria: Notice Criterion: Enrolment in a relevant professional register Description: having a current entry in the register of entities introducing products, products in packaging and managing waste � the BDO register, referred to in art. 49 of the Act of 14 December 2012 on waste (consolidated text: Journal of Laws of 2023, item 1587, as amended), maintained by the relevant voivodeship marshal Criterion: Professional risk indemnity insurance Description: The Ordering Party requires that the Contractor be insured against civil liability (OC) within the scope of the business activity related to the subject of the contract in the amount of not less than PLN 200,000.00, while the validity of the policy (and in the absence of another insurance document) must cover at least the day of submission of the offer. NOTE: 1. In the event of presentation (upon the Ordering Party's request to submit subjective evidence) by the Contractor of a policy or other document confirming,that the Contractor is insured against civil liability, not covering the date of conclusion of the contract on the award of the public procurement contract, the Contractor shall be obliged to submit to the Ordering Party, before concluding the contract, a policy or a document confirming the fact of having insurance in the indicated scope. 2. In the event that the Contractor presents a policy or another document confirming that the Contractor is insured against civil liability not covering the entire period of execution of the order, the Contractor shall be obliged to submit to the Ordering Party subsequent paid policies or other documents confirming this circumstance during the period of execution of the subject of the order; Criterion: References on specified services Description: The Ordering Party will consider a Contractor to meet this condition if it proves that during the last 3 years preceding the date of the deadline for submission of offers, and if the period of conducting business activity is shorter - during this period, it has duly performed or is performing at least one service provided continuously for a period of at least 12 months consisting in cleaning surfaces, including road surfaces or sidewalks, with a value of not less than PLN 777,600.00 gross (in words: seven hundred seventy-seven thousand six hundred zlotys gross) - for each of these services, NOTE: 1) If the Contractor demonstrates experience acquired under a contract (order/agreement) performed by contractors jointly applying for the award of the contract (consortium), the Ordering Party does not allow the Contractor to rely on the experience of a group of contractors of which it was a member, if it did not actually and specifically perform the demonstrated scope of the service. The Ordering Party reserves the right to ask the Contractor for clarifications regarding the scope of the service actually performed and to present relevant evidence, e.g. a consortium agreement, from which the scope of obligations results, or invoices issued by the Contractor. 2) The Ordering Party will also consider the SWZ condition to be met if the experience demonstrated by the Contractor covers a wider scope of service than that required by the Ordering Party. 3) The Ordering Party does not allow the aggregation of services performed under separate contracts (agreements/orders) in order to obtain the required value condition. Criterion: Tools, plant, or technical equipment Description: The Ordering Party will consider the Contractor to meet this condition if it proves that it has or will have at least: 1) three mechanical sweepers, including two self-propelled ones with a sweeping capacity of 11,200 m2/hour, 2) two vehicles for collecting municipal waste from manual cleaning (sweeping) and municipal waste from emptying bins. NOTE: The Ordering Party requires that all devices and vehicles are in good technical condition and that the vehicles meet the requirements specified in the Regulation of the Minister of Infrastructure of 31 December 2002.on the technical conditions of vehicles and their necessary equipment (Journal of Laws of 2024, item 502) and had valid technical inspections in accordance with the provisions of the Act of 20 June 1997 - Road Traffic Law (i.e. Journal of Laws of 2024, item 1251, as amended) and civil liability insurance. 5.1.10. Award criteria Criterion: Type: Price Name: PRICE Description: The lowest gross offer price for the execution of the subject of the order, which is the sum of the gross component prices referred to in section I, sec. 3 points 1 and 2 of the Bid Form constituting Appendix No. 2 to the SWZ, which consists of: 1) price within the scope of tasks I, II, III, V, VI, VII specified in the Detailed Description of the Subject Matter of the Order - Appendix No. 1 to the SWZ, 2) price within the scope of task IV specified in the Detailed Description of the Subject Matter of the Order - Appendix No. 1 to the SWZ. Criterion weight: 60 points Calculation of points under the "price" criterion will be made according to the formula: Cc = (Cmin/Cx) x 60, where: Cc - number of points for the "price" criterion, Cmin - the lowest gross bid price resulting from the submitted bids, Cx - gross bid price of the examined bid. Criterion: Type: Quality Name: EMERGENCY CLEANING RESPONSIVE TIME Description: The Contractor who offers in their bid the fastest emergency clean-up response time (no longer than 24 hours) will receive the maximum number of points under the �emergency clean-up response time� criterion, i.e. 40 points. Other Contractors whose bids include a longer emergency clean-up response time will be assigned an appropriately lower (proportionally lower) number of points. Criterion weight: 40 points The calculation of points under the "response time to emergency cleaning" criterion will be made according to the formula: Cr = (Cmin/Cx) x 40, where: Cr - number of points for the "response time to emergency cleaning" criterion, Cmin - the fastest execution time for emergency cleaning resulting from the submitted offers, Cx - time of handling a complaint of the examined offer. 5.1.11. An appeal may be lodged against: 1) an action by the Ordering Party that is inconsistent with the provisions of the Act, undertaken in the contract award procedure, the Contractor qualification system, including the draft provision of the contract; 2) failure to take action in the contract award procedure, the Contractor qualification system, to which the Ordering Party was obliged under the Act; 3) failure to conduct the contract award procedure or organize a competition under the Act, despite the fact that the Ordering Party was obliged to do so. 5. The appeal shall be lodged within 10 days of the date of providing information about the Ordering Party's action constituting the basis for lodging it, if the information was provided using electronic means of communication, or within 15 days - if it was provided in another way. 6. An appeal against the content of the announcement initiating the procedure for awarding the order or against the content of the order documents shall be lodged within 10 days of the date of publication of the announcement in the Official Journal of the European Union or posting of the order documents on the website. 7. An appeal in cases other than those specified in par. 5 and 6 shall be lodged within 10 days of the date on which the information constituting the basis for lodging it was obtained or, with due diligence, could have been obtained. 8. If the Ordering Party has not published a notice of intention to conclude a contract or, despite such obligation, has not sent the Contractor a notification of selection of the most advantageous offer or has not invited the Contractor to submit a bid under a dynamic purchasing system or framework agreement, an appeal shall be lodged no later than: 1) 30 days from the date of publication of the contract award notice in the Official Journal of the European Union, 2) 6 months from the date of conclusion of the contract, if the Ordering Party: a) has not published a contract award notice in the Official Journal of the European Union or b) has published a contract award notice in the Official Journal of the European Union that does not contain a justification for awarding the contract in the negotiated procedure without publication or a single-source procurement. 5.1.15.
