Es podrà interposar recurs especial en matèria de contractació regulat en l’article 44 i següents de la LLCSP, contra els actes enumerats a l’article 44.1 LLCSP, entre els que es troben els anuncis de licitació, els plecs reguladors de la present licitació i els documents contractuals que estableixin les condicions que hagin de regir la contractació, contra els actes de tràmit adoptats en el procediment d’adjudicació, sempre que aquests darrers decideixin directa o indirectament sobre l’adjudicació, determinin la impossibilitat de continuar al procediment o produeixin indefensió o perjudici irreparable a drets o interessos legítims, i contra els acords d’exclusió que li afecti o d’adjudicació. Aquest recurs té caràcter potestatiu. Alternativament, es podrà interposar recurs contenciós administratiu, de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa 2. El recurs es podrà interposar per les persones físiques i jurídiques, els drets o interessos legítims de les quals s’hagin vist perjudicats o puguin resultar afectats per les decisions objecte de recurs, i en tot cas pels licitadors. 3. Tot aquell que es proposi interposar un recurs contra algun dels actes indicats al punt primer d’aquesta clàusula haurà d’anunciar-ho prèviament mitjançant un escrit on especifiqui l’acte del procediment que serà objecte del mateix. Aquest escrit s’haurà de presentar davant l’òrgan de contractació de Foment de Ciutat, SA, en el termini especificat a l’apartat següent per la interposició del recurs. 4. El termini per a interposar el recurs especial en matèria de contractació serà de 15 dies hàbils, a comptar d’acord amb allò establert a l’article 50 de la LLCSP, en funció de quin sigui l’acte que es recorri. 5. A special appeal may be filed in matters of contracting regulated in article 44 et seq. of the LLCSP, against the acts listed in article 44.1 LLCSP, between those that contain the tender announcements, the regulatory documents for this tender and the contractual documents that establish the conditions that must govern the procurement, against the procedural acts adopted in the award procedure, provided that the latter decide directly or indirectly on the award, determine the impossibility of continuing the procedure or produce defenselessness or irreparable damage to rights or legitimate interests, and against the exclusion agreements that affect it or the award. This resource is optional. Alternatively, an administrative contentious appeal may be filed, in accordance with Law 29/1998, of July 13, regulating administrative contentious jurisdiction 2. The appeal may be filed by natural and legal persons, the rights or legitimate interests of which have been harmed or may be affected by the decisions subject to appeal, and in any case by the tenderers. 3. Anyone who intends to file an appeal against any of the acts indicated in the first point of this clause must announce it in advance by means of a written statement specifying the act of the procedure that will be the subject of it. This letter must be presented to the contracting body of Foment de Ciutat, SA, within the period specified in the following section for the filing of the appeal. 4. The deadline for filing the special appeal in matters of contracting will be 15 working days, to be counted in accordance with what is established in article 50 of the LLCSP, depending on the act that is appealed. 5.
