Amb la divisió en lots de l'objecte del contracte: a) s’incrementaria el risc d’efectuar l’execució excessivament costosa des del punt de vista tècnic, tenint en compte les possibles afeccions al medi hídric que pot comportar una mala gestió o manteniment dels sistemes de sanejament. b) es perd l'optimització del control de l'execució global del contracte i la coordinació de l'execució de les prestacions. c) es perd l'eficiència, la majoria de les instal·lacions objecte del contracte són de dimensions reduïdes per la qual cosa els equips d’explotació són compartits entre elles, es comparteixen el cap de planta i l’oficial de manteniment. d) s'incrementen els costos d'execució per l'existència d'una pluralitat de contractistes diferents, haver de multiplicar la necessitat d’efectius, molts dels quals haurien d’operar en jornades parcials molt reduïdes perquè les dimensions de les diferents instal·lacions no justifiquen dedicacions a jornada completa; l’agrupació de totes elles en un únic contracte permet aprofitar al màxim tècnicament tots els recursos. e) es perden les economies d'escala, es podria donar lloc a lots molt desequilibrats en la rendibilitat de l’explotació i provocaria que l’execució del contracte fos excessivament costós també des del punt de vista econòmic, sobretot pel que fa al personal, ateses les dimensions i característiques de bona part de les instal·lacions, la qual faria no rendible la seva explotació i manteniment per separat. Els anuncis de licitació, els plecs i els documents contractuals que estableixin les condicions que hagin de regir la contractació; els actes de tràmit adoptats en el procediment d’adjudicació, sempre que aquests decideixin directament o indirectament sobre l’adjudicació, determinin la impossibilitat de continuar el procediment o produeixin una indefensió o un perjudici irreparable a drets o interessos legítims; els acords d’adjudicació, i les modificacions basades en l’incompliment del que estableixen els articles 204 i 205 d’aquesta Llei, perquè s’entén que la modificació havia de ser objecte d’una adjudicació nova, són susceptibles de recurs especial en matèria de contractació. The tender announcements, specifications and contractual documents that establish the conditions that must govern the procurement; the procedural acts adopted in the award procedure, provided that they decide directly or indirectly on the award, determine the impossibility of continuing the procedure or produce a defenselessness or irreparable damage to legitimate rights or interests; award agreements, and modifications based on non-compliance with the provisions of articles 204 and 205 of this Law, because it is understood that the modification had to be the subject of a new award, are subject to special appeal in recruitment matter.The filing of the special appeal in matters of recruitment is discretionary and is free of charge for the appellants.
