OBRES D’INSTAL·LACIÓ FOTOVOLTAICA A L’EDAR D’ALFARA DE CARLES PER A L’AUTOCONSUM AMB EXCEDENTS ACOLLITS A COMPENSACIÓ 2070/2024 Consell Comarcal del Baix Ebre CONSELL COMARCAL DEL BAIX EBRE Anunci de licitació LCSP (contractes del sector públic) OBRES D’INSTAL·LACIÓ FOTOVOLTAICA A L’EDAR D’ALFARA DE CARLES PER A L’AUTOCONSUM AMB EXCEDENTS ACOLLITS A COMPENSACIÓ Segons la Llei 16/2017 del canvi climàtic i en aplicació de l’article 28.2, al 2020 un mínim del 20% del consum energètic total del conjunt de les instal·lacions públiques de gestió de residus, de sanejament d’aigües residuals urbanes i de potabilització d’aigua, la gestió de les quals és competència dels departaments de la Generalitat o dels organismes que en depenen haurà de procedir de fonts pròpies d’origen renovable. Des dels Serveis Tècnics del COPATE l'any 2023, en nom del Consell Comarcal del Baix Ebre (CCBE), es va realitzar l’estudi de viabilitat d'una instal·lació fotovoltaica d'autoconsum per l'EDAR d’Alfara de Carles. Es va plantejar aquesta instal·lació a l’EDAR d’Alfara de Carles perquè disposa d'espai suficient dins de les instal·lacions, amb la instal·lació de plaques fotovoltaiques per autoconsum que reduiran les emissions i contribuiran al procés de transició cap a una economia baixa en carboni. D’acord amb això es proposa la contractació de les obres del “projecte constructiu d’instal·lació fotovoltaica a l’EDAR d’Alfara de Carles per a l’autoconsum amb excedents acollits a compensació” com a necessitat per a complir amb la llei 16/2017 del canvi climàtic i en aplicació del seu article 28.2. No obstant, contra les resolucions i els actes de tràmit que decideixin, directa o indirectament, el fons de l'assumpte, determinin la impossibilitat de continuar el procediment, produeixin indefensió o perjudici irreparable a drets i interessos legítims, de conformitat amb l'article 112.1 de la Llei 39/2015, d'1 d'octubre, podrà interposar el recurs potestatiu de reposició que caldrà fundar en qualsevol dels motius de nul·litat i anul·labilitat previstos en els articles 47 i 48 de la citada Llei.
