Serveis Obert Altres Amb lots Contra el present acord es pot interposar potestativament el recurs especial en matèria de contractació a que es refereix l’article 44 i següents de la Llei 9/2017, de 8 de novembre, de Contractes del Sector Públic (LCSP), davant del Tribunal Català de Contractes de Sector Públic com a òrgan competent per a la resolució del recurs. El termini per interposar aquest recurs és de 15 dies hàbils a comptar des del dia següent a aquell en que s’hagi efectuat la notificació. Es podrà també interposar recurs especial fonamentat, en el seu cas, en alguna de les causes de nul·litat previstes a l’apartat 2 de l’article 39 de la LCSP, en els terminis que s’indiquen a les lletres a) i b) de l’article 50.2 de la LCSP. L’escrit d’interposició del recurs podrà presentar-se davant el registre de l’Òrgan de Contractació, en el registre del Tribunal Català de Contractes del Sector Públic o en qualsevol dels llocs establerts a l’article 16.4 de la Llei 39/2015, d’1 d’octubre, del Procediment Administratiu Comú de les Administracions Públiques, donant compliment al que s’estableix a l’article 51 de la LCSP. Transcorregut 2 mesos comptats des del següent a la interposició del recurs sense que s’hagi notificat la seva resolució, l’interessat podrà considerar-lo desestimat als efectes d’interposar recurs contenciós administratiu.
