Aquest recurs té caràcter potestatiu, i s’interposarà davant el Tribunal Català de Contractes del Sector Públic. Alternativament, es podrà interposar recurs contenciós administratiu, de conformitat amb la Llei 29/1998, de 13 de juliol, reguladora de la jurisdicció contenciosa administrativa. Contra els actes susceptibles de recurs especial no procedeix la interposició de recursos administratius ordinaris. 2. Els que adopti l’òrgan de contractació que no siguin susceptibles de recurs especial en matèria de contractació, procedirà la impugnació per la via administrativa de conformitat amb el que estableix la Llei 39/2015, del Procediment Administratiu Comú de les Administracions Públiques davant de l’Ajuntament del Prat de Llobregat. 3. Per resoldre qualsevol discrepància que pogués sorgir en la interpretació, efectes, compliment i extinció del Contracte, les parts es sotmetran a la jurisdicció i competència dels jutjats i tribunals de la ciutat de El Prat del Llobregat, amb renúncia de qualsevol altre fur que pogués correspondre’ls. This appeal is optional, and will be brought before the Catalan Court of Public Sector Contracts. Alternatively, an administrative contentious appeal may be filed, in accordance with Law 29/1998, of July 13, regulating administrative contentious jurisdiction.
