Tram del carrer de la Selva del Camp fins Castellmoster, paral·lel a la TV-7048” L'objecte del present projecte és la realització de les obres contingudes en el projecte “Segona fase del vial pedalable i de vianants. Tram del carrer de la Selva del Camp fins Castellmoster, paral·lel a la TV-7048”. Es tracta de la segona fase d’aquest vial. La primera fase, que anava des del final del carrer Pugets fins el carrer de la Selva del Camp, es va acabar el passat mes d’octubre de 2022. Finalitzades les obres d’execució de la primera fase, des d’Alcaldia es sol·licita que es realitzin els treballs de la segona fase per finalitzar el projecte. L’actuació consistirà amb donar continuïtat a l’actual tram de vianants, realitzant un nou vial pedalable i de vianants (segona fase) per garantir la connexió, entre el nucli urbà de Castellvell del camp fins l’entrada de les urbanitzacions de Castellmoster, Erbosseres i Flor del Camp, tot paralꞏlel a la TV-7048 (carretera de Castellvell del Camp a Almoster). El projecte també preveu el plantat d’arbrat pel tram del vial de la primera fase i també preveu l’adequació de la zona verda com a refugi climàtic. Contracte Ordinària ? Obres Obert Sobre digital Sense lots L’objecte d’aquest contracte es materialitza en l’execució d’una obra completa. Per aquest motiu, la present licitació no es divideix en lots, essent les prestacions a contractar una totalitat dels treballs necessaris per a la correcta i completa execució de les obres, que han de ser tractades de forma conjunta i global. Segons el que s’estableix al projecte, les tasques a realitzar són una sèrie de reparacions a diferents punts, especialment centrades en l’arranjament de paviments existents i mesures destinades a evitar pèrdues de la xarxa de distribució i subministrament d’aigua i per reduir el consum energètic del municipi. Aquestes obres han d’estar coordinades i executades segons una programació total de l’obra. La divisió de l’obra en lots dificultaria la seva correcta execució donada la necessitat de coordinar l’execució de les diferents prestacions entre les diverses empreses adjudicatàries a més de la necessària coordinació tècnica de les diferents prestacions que es podria veure compromesa. Aquesta és la raó per la qual, atesa a la seva naturalesa, en aplicació de l’article 99.3 b) de la LCSP, es considera que aquest contracte d’obres no s’ha de dividir en lots. Si es vol impugnar la present resolució, que posa fi a la via administrativa, procedeix interposar recurs contenciós administratiu davant el Jutjat Contenciós Administratiu de Tarragona, en el termini de dos mesos a comptar de l'endemà de la seva notificació. Alternativament i de forma potestativa, es pot interposar recurs de reposició davant el mateix òrgan que l’ha dictat, en el termini d’un mes a comptar de l'endemà de la seva notificació. Castellvell del Camp S'ha fixat una durada màxima de sis (6) mesos per la realització de les obres contingudes en el projecte “Segona fase del vial pedalable i de vianants. Tram del carrer de la Selva del Camp fins Castellmoster, paral·lel a la TV-7048”. Aquest termini comença a comptar des de la data de l'acta de la comprovació del replanteig. L’acta de comprovació del replanteig s’ha d’estendre en el termini màxim d’un (1) mes a comptar des de la formalització del contracte. Si per causes de força major, o independentment de la voluntat del contractista, no es pogués començar les obres, o bé s'hagués de suspendre, o bé no es pogués acabar en els terminis fixats, se li atorgarà una pròrroga proporcionada pel compliment del contracte, previ informe favorable del Director de les Obres, la causa que impedeix l'execució o el ritme normal de les obres, raonant degudament la pròrroga que per aquest motiu es sol·licita.
