Overview | Mpca Natural Resource Damage Assessment ADDENDUM 2 Uploaded ADDENDUM 1 Uploaded The Minnesota Pollution Control Agency (“MPCA” or “State”) request proposals from qualified Contractors to provide a full range of activities for conducting Natural Resource Damage Assessment (NRDA) services and other natural resource assessment and restoration planning projects. State authority is set forth in the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), 42 U.S.C. §9607, as implemented by the National Oil, Hazardous Substance, Pollution Contingency Plan (NCP), 40 C.F.R. 300.600-300.615; the Oil Pollution Act (OPA), 33 U.S.C. §2702; the Federal Water Pollution Control Act (FWPCA), as amended, 33 U.S.C. §1251; the Water Pollution Act, Minn. Stat. § 115; and the Minnesota Environmental Response and Liability Act (MERLA), Minn. Stat. § 115B. These statues authorize the State to recover damages for injury to, destruction of, or loss of natural resources and services provided by natural resources resulting from a release of hazardous substances. The MPCA and DNR are Co-Trustees for Natural Resource and is responsible for compensating the public for lost natural resources and their services resulting from releases of petroleum or hazardous substances.
