Procurement will be conducted through bid evaluation procedures using non- discretionary pass/fail criteria under pertinent provisions of Republic Act No. 9184 and its Implementing Rules and Regulations. The BAC shall check the submitted documents of each bidder against a checklist of required documents to ascertain if they are all present, using a non-discretionary “pass/fail” criterion. If a bidder submits the required document, it shall be rated “passed” for that particular requirement. In this regard, bids that fail to include any requirement or are incomplete or patently insufficient shall be considered as “failed”. The price quotation and eligibility documents must be submitted on or before 29 October 2024, 12:00nn to the MTRCB-BAC Secretariat at the MTRCB Building No. 18 Timog Avenue, Quezon City, Philippines in a sealed envelope marked as follows: The Chairperson MTRCB Bids and Awards Committee (BAC) Request for Quotation Supply, Delivery and Installation of Air Conditioning Unit in Various Locations of the MTRCB Building. Please note that price quotations submitted after the above-mentioned deadline shall not be accepted. The Contract will be awarded to the Participating Service Provider whose price quotation is the most advantageous and responsive to MTRCB in accordance with the MTRCB’s judgment and discretion. MTRCB shall not be bound to accept the lowest or any price quotation, which, in its judgment, is, in the ultimate analysis, not advantageous to the government. In case of two or more bidders are determined to have submitted the Lowest Calculated Quotation/Lowest Calculated and Responsive Quotation, the MTRCB-BAC shall adopt and employ "toss coin" as the tie-breaking method to finally determine the single winning provider, applying by analogy the guidelines provided in GPPB Circular 06-2005. Furthermore, the MTRCB-BAC reserves the right to accept or reject any price quotation, waive any formality in the RFQ, annul the procurement process, reject any or all price quotations at any time prior to contract award, declare the procurement process as failure, without thereby incurring any liability to the affected Participating Service Provider of any person.
