The scope of this RFP (including all options)does not include video lottery, casino gaming, internet-based lottery sales, orother activities, goods or services not authorized by law.The TexasLottery currently contracts with a single vendor (the LotteryOperator)for lottery operations and services. The Lottery Operator provides a wide rangeof goods and services essential to the delivery of lottery gaming services.This integrated approach for the provision of the Lottery Gaming System and thesales, marketing, warehouse, distribution and related services has beensuccessful. The Texas Lottery believes that the current integrated operatingmodel provides a cohesive approach to game development, systems support, sales,marketing and distribution and mitigates risk to the revenue streamthat providesfunding for education, veterans’ assistance, and other governmental purposes asrequired by the Texas Legislature.The Texas Lottery is not predisposed toany particular solution or service delivery methodology, nor does the TexasLottery intend to limit the creativity of interested parties. Two or moreentities may collaborate to file a Proposal, but they shall designate a singleentity that will contract with the Texas Lottery and be responsible for thedelivery of all goods, services and requirements set forth in its Proposal(i.e., the Lottery Operator). All Proposals submitted shall completely definethe responsibilities of the primary contractor (Lottery Operator) and eachparticipating Subcontractor.Proposersshould refer to the Schedule of Events contained in the RFP for importantfiling deadlines. Letter of Intent and executed Non-Disclosure Agreement shallbe submitted in accordance with Sections 2.4 and 2.5. Cost Proposals, Set-upCosts and Proposer’s Commitmentshall besubmitted in accordance with Section 2.16. Technical Proposals, BidBond/Proposals Surety and Protest/Litigation bond shall be submitted inaccordance with Section 2.9. Prior to submitting a response to this RFP,Proposers are advised to re-check this posting for any possible additionalinformation or amendments.The TexasLottery Commission is a part of the Executive Branch of Texas State Government.The Texas Lottery will not relinquish control over lottery operations. TheSuccessful Proposer shall function under the supervision of the Texas Lottery.Its operations will be subject to the same scrutiny and oversight that wouldapply if all operations were performed by Texas Lottery employees. Accordingly,all operations shall be conducted in adherence to applicable statutes and thehighest ethical standards.ThisRFP and all activities leading toward the execution of a written contract underthis RFP are being conducted in accordance with the State Lottery Act (Tex.Gov't Code.§§ 466.001, et seq.), as amended; the Texas Lottery's administrativeregulations (16 TAC §§ 401.101, et seq.); and other applicable laws of theState of Texas.
